BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended,
a public hearing will be held in the SECOND FLOOR MEETING ROOM, City
Hall, Aspen, Colorado, (or at such other place as the meeting may be
then adjourned) to consider an application filed with the said Board
of Adjustment requesting authority for variance from the provisions of
the Zoning Ordinance, Chapter 24, Official Code of Aspen. All persons
affected by the proposed variance are invited to appear and state their
views, protests or obj ections. If you cannot appear personally at such
meeting, you are urged to state your views by letter, particularly if
you have objection to such variance, as the Board of Adjustment will
give serious consideration to the opinions of surrounding property
owners and others affected in deciding whether to grant or deny the
request for variance.

COVERAGE VARIANCE, CASE# 94-3
Dear Bill,
The owner of the above referenced property hereby requests that the Board of Adjustment
reconsider and clarify conditions placed on a variance granted on March 24,1994.
The Board granted a 200 sf coverage variance for the construction of a garage within the
allowable setbacks. It also stated as part of this approval that no second floor space or deck
could be built above the garage. This later condition was added based on an interpretation from
Staff regarding the 5 foot rule regarding rear yard setback reductions for portions of buildings used
"only as garages." As you recall, in a subsequent meeting with the Francis, this interpretation was
reviewed and overruled as inconsistent with department policy.
As mentioned in the original review, placement of additional space above the garage is necessary
to avoid demolition and alteration of the historical portions of the house. The original plans have
been revised and have been reviewed and approved by HPC. These plans reduce the necessary
coverage variance to 146.5 sf, reduce the garage to one car, demolish and relocate utility spaces
in basement, provide a 10 foot rear yard setback (which does not take advantage of 5 foot
"garage-only" rule) and provide a 10 foot easterly side yard setback.
The applicant is now asking for reconsideration of the conditions of the variance based on this
revised interpretation and requests that a second floor be allowed above the revised and
repositioned garage. Activity of the second floor space has been focused to the South to
minimize impact on Easterly neighbor.
