BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the SECOND FLOOR MEETING
ROOM, City Hall, Aspen, Colorado, (or at such other place as the
meeting may be then adjourned) to consider an application filed
with the said Board of Adjustment requesting authority for variance
from the provisions of the zoning Ordinance, Chapter 24, Official
Code of Aspen. All persons affected by the proposed variance are
invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

BACKGROUND
Dr. and Mrs. Edward Watson were granted a Rear Yard Setback Variance In September
1991 to permit the construction of a 1 car garage at their house located at 121 W. Bleeker.
Aller completion of construction of the garage it became evident that the Watson's
children and their friends were gaining access to the garage roof from a window in the
upper level of the east end of their adjacent playhouse. (The children were going onto
the roof to retrieve balls, Frisbees, etc.) In addition, the upper level of the playhouse is
remote from the main house as it is connected only by lower level breezeway, and it was
feared that in case of fire the children would require egress from their upper level play
area. This added to the need to make the garage roof safe and able to be exited. Hence
the safety rail and circular stair were erected in June of 1993.
VARIANCE REQUEST
This variance is respectfully requested as it would pennit a rail and stair that are not only
necessary from a safety standpoint but also present minimal visual impact. (Please see
attached photographs.) The rail is constructed of one inch steel tubing and stainless
steel cables and is therefore difficult at best to see, and the circular stair is in fact located
behind the garage to make it Impossible to see from any public viewpoint

I am writing this in regards to the fence on top of the garage of
the Watson residence at 121 W. Bleeker . Neither the Management
nor the Hotel guests have any complaints against the fence. The
comments I have heard have all been favorable.

Re: Garage Railing
Diane:
Please pass along this letter to the proper authorities . We feel
that the garage railing is not at all architecturally disturbing to
the neighborhood; on the contrary, it reminds us of the widows'
walk so often seen on true Victorians . Furthermore, as our
children play with yours, the added safety feature should outweigh
any concerns of the committee objecting; particularly since the
rail is not really visible from the street .
