DEVELOPMENT APPLICATION
SUMMARY OF REQUEST
The Applicant has proposed a small addition to the existing
improvement on this lot, to convert the existing single family
dwelling to a duplex, which is allowed by right in this zone. The
one-story, low impactive and complementary addition has been
approved by HPC, and complies with the allowable FAR, height and
other R-6 zoning regulations.
The Applicant requests a variance to permit 289.3 sq. ft. (of
the 420 sq. ft. of the new addition) as additional site coverage
(See Site Plan, Exhibit "A"). This 1.48% increase in site coverage
will allow the addition to remain one story rather than creating a
two-story addition which would be more impactive to the neighbor-
hood (See Elevation, Exhibit "B").
The lot contains 19,592 sq. ft. and is one of the larger lots
in this neighborhood. Because permitted site coverage in R-6 is
reduced as the lot size increases, the size of this lot restricts
the site coverage disproportionately to other smaller lots in the
vicinity. Even with this slight increase in site coverage, the
open space for this lot remains nearly 80%.

Plan by ensuring compatibility with an existing historic feature.
The variance will prevent the loss of historic architecture by
allowing a sensitive addition adjacent to the historic resource,

A. There are special conditions and circumstances which
are uniGue to this parcel. buildinG or structure. which are not
apPlicab~~ ~o other Darcels. structures or buildinGs in the same
zone dis i t and which do not result from the actions of the
Applicant. This site is the most prominent site on the ridge
overlooking the post office, Clark's Market and the bike trail,
highly visible to the entire community, and contains a designated
historic residence. The site and the historic structure are
special circumstances which were not created by the Owner/Applicant
and do not exist on other parcels in this zone. The variance will
allow the least visually impactive structure on the site for the
neighborhood and community.
B. This Grant of variance will not confer upon the
ADPlicant anv special privileGe denied bv the Aspen Area Comprehen-
sive Plan and the terms of this chapter to other parcels. build-
inas. or structures. in the same zone district. This variance will
not confer any special privilege upon the Applicant. This is a
very large lot (19,592 sq. ft.), with an allowable FAR of 4,247.6
sq. ft., with a duplex being a use by right. The variance will
merely allow the Applicant to reduce the visual impact of an
addition on the nearby community post office complex, on the
historic main house and the neighborhood itself.

As stated above, the fact that this lot is larger than
most R-6 lots in this area, and because of the Code requirement
that site coverage is reduced as the lot size increases, this lot
is at a disadvantage as to other lots in this zone with regard to
site coverage allowable for a one-story, low impactive structure.
For example, a lot of only 4,499 sq. ft. is permitted site coverage
greater than allowed on this lot.

THIS DEED RESTRICTION is made this day of August, 19931,
the undersigned, Owner of real property described as
, Aspen, Colorado ("Property").
RECITALS:
A. The Owner requested a variance from the Aspen Board of
Adjustment to allow an additional 140 square feet of site
coverage for a proposed duplex unit on the Property, which lies
within the R-6 zone.
B. On August 5, 1993, the Aspen Board of Adjustment (Case
Number 93 - 7) granted a variance from the City Municipal Code
regulations to allow additional site coverage on the Property of.
an additional 140 square feet. '
C. The Board of Adjustment placed certain conditions upon.
the grant of variance, which conditions are listed below and are:
intended to run with the title to the Property.
D. The OWner acknowledqes that theqrant of variance is
SUbject to such conditions which are made a part of this Deed
Restriction.
THE GRANT OF VARIANCE, ASPEN BOARD OF ADJUSTMENT CASE NO.
93-7, allows additional site coveraqe on the Property of an
additional 140 square feet, pursuant to plans submitted by the
Owner, approved by the Historic Preservation committee and the
City of Aspen Buildinq Department. This grant of variance is
subject to the followinq conditions, which shall run with the
title to the Property:
1. The downstairs duplex unit shall be deed-restricted as
an Accessory Dwellinq Unit pursuant to Aspen Ordinance 60 - 90.
2. There shall never be a second story addition to the
existing historical house.

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state
your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.
