TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such .meeting, you are urged to state
your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

1. DESCRIPTION OF PROPOSED VARIANCE:
At this time the southwest corner of our first floor kitchen is in
the setback (within 25 feet of our road). We would like to be able
to square off the sloped roof over that corner when we add a second
floor. See attachment!3# 1/3 for the exact dimensions.
2. REASON FOR REQUESTED VARIANCE:
As you can see, we didn't plan to build enclosed space over the
setback. After designing a flat deck in that space, we learned
that the railing would create a problem with the setback.
Finally, we learned that building up that corner of the roof to
create a flat surface on the front of the house up to the new
second floor would also be considered an encroachment. Therefore
we are asking the Board of Adjustment to consider a variance.
3. JUSTIFICATION FOR PROPOSED VARIANCE:
In the process of this application we have tried to provide
justifications based on all required circumstances.
A. We believe our request does not oppose the spirit of the
code or the Aspen plan. In fact, with this addition we will
actually reduce the existing impact within the setback. Our plan
includes removing the existing front entry and the portico covering
it, including moving the gate and removing concrete steps to the
entry. We also plan to remove a large part of the existing deck
and replace it with flower gardens in front of the house .",ee ,..\t(l.Ch, A-
B. We believe we are asking for the minimum variance.
C. We think that there are special circumstances unique to
our parcel and situation:
1. After a lot of research aimed at understanding how and why
this duplex happened to be built within the setback, we have found
one possible answer. It may not be relevant. Copies of the
original building permit for the duplex in 1968, and copies of the
building permit for the subsequent addition of the deck in 1973
(both attached) indicate that this area was believed to be zoned
R-6 during those years. With the different setback applied, the
building could have been within the code at that time.
2. Subsequent annexation of this area by the City occurred in
1987, and the zoning is now R-15A. However, a further example of
the unique curcumstances of this area is that we have a private
road, which we privately and jointly maintain with our neighbors
with no contribution from the City.
3. Our duplex was angled on our narrrow lot, which causes a
small corner of the front half to be in the current setback.
4. We believe that a hardship exists in that this situation
is due to zoning and/or annexation changes. We hope decreasing the
overall impact in the setback will be favorably considered along
with the appearance of a deck vs. the option of a strange roofline.
