MEMORANDUM TO: city of Aspen Board of Adjustment FROM: Bill Drueding, zoning Officer DATE: July 8, 1992 RE: Case #92-9, Savanah Limited partnership The staff supports the above variance request as it is a means of eliminating an on street parking problem related to the construction of the Ritz Carlton Hotel. The staff notes that section 10-104(2), attached, was adopted by the city to specifically address issues such as the need for construction staging during construction projects. Some of the concerns of staff that the applicant should address are dust control and tracking of mud onto public streets, hours of use (noise), duration of use, number of vehicles, required grading, lighting, access locations and signs. The request is for the use of two (2) parcels. The first is the parking lot on South Aspen Street, South of Juan Street across from the Skier's Chalet, legally described as Eames Addition, Block 11, Lots 7 - 12, The second is approximately one acre bordered by Aspen Street to the East, Garmisch Street to the West, Juan Street to the South and the Uft One Condominiums to the North, legally described as Eames Addition, Block 6. This summer the Ritz-Carlton is experiencing the height of the construction manpower. The City land use code does not require mitigation by a developer of housing, parking or other temporary manpower-related impacts associated with a construction project. Nonetheless, Savanah has been sensitive to the impacts on the Aspen community associated with the project, At a substantial loss of income, we have converted the Grand Aspen Hotel to construction worker housing. We leased the Aspen Country Inn for all of last winter to provide still further housing, Now that we are housing workers in the Grand Aspen Hotel, we need to address the issue of auto parking, We have some 57 spaces on the West side of the Grand Aspen Hotel and another 20 plus on the East side, The lot in front of the Grand Aspen Hotel has about 30 spaces plus construction material storage, The Top of Mill site is used for equipment and material storage, The garage in the Ritz-Carlton cannot be used for two reasons; there is no Certificate of Occupancy on the space and security needs precludes worker access to the site, 600 E.Coupcr SI Suile :2()() . .\Spt'll. CO HI () 11 . 3():~/q2J--l-:27::! . r:.\:\ q:2__,-...L~H, . \ City of Aspen June 11, 1992 Page -2- Currently, there is no problem parking the workers automobiles, The area around the Ritz-Carlton has no timed parking or overnight restrictions, This is logical because there are many small lodges in the area and guests need to store cars on the street. However, once the summer season begins, I foresee a conflict developing over parking. It is only right that Savanah do all that we can to accommodate our requirements without impacting our neighbors, The parking lot parcel on Aspen Street is leased all winter to the Aspen Skiing Company as a parking lot. Thus, there should be no difficulty allowing this site to be used during the summer for automobile storage for construction workers, The Northern portion will be accessed off of Juan or Aspen Street and will be used as needed for vehicles if the upper parking lot is full. These uses meet the City code definition of a temporary use as "uses required in the construction phase of development, or which are uniquely seasonal in nature," By allowing for the use of these sites for parking for the summer and fall months, the public safety and welfare will be served without compromising the integrity of the City's zoning and planning process. Certainly the Ritz-Carlton Hotel is a special circumstance given the sheer size of the labor force involved, The zoning code allows parking lots in the commercial core only, The literal enforcement of the code in this case would not allow temporary worker parking in either the R-15 (PUD) L zone (the upper parcel) or in the LlTR zone (the lower parcel) . Under Section 10-104, the Board shall make a finding that the following three (3) circumstances exist: 1. The grant of a variance in generally consistent with the comprehensive plan to remove parking form the streets and provide off-street parking in connection with the development activities, 2. Granting of use of these properties for surface parking of personal vehicles is the minimum variance that will allow the reasonable use of the parcel. 3. Any construction project allows for the temporary storage of vehicles and equipment on-site, In this instance, additional room is needed beyond the PUD properties to ease the burden on the streets of Aspen and on the neighbors to the project. Granting of this variance will not confer any special privilege denied to other construction projects throughout the City, .j City of Aspen June 11, 1992 Page -3- Granting of this variance will afford relief to the applicant and to the neighborhood adjacent to the project, The parking lot is used as a lot all winter, Continued use will not impact anyone, Use of the land North of the lot, as needed, will not disrupt anyone and will greatly improve the normal neighborhood activities surrounding the Ritz. To not allow this temporary use will cause great practical difficulty. We looked at an intercept program at Buttermilk and at passes for the Rio Grande garage. While we could rent a bus and use the Buttermilk lot, we could not police all employee parking to ensure use of the lot. The same is true if we wanted people to use the parking garage, By providing convenient parking the construction workers can have tools close to the site and can have secure parking which will give us the best provision for people using the parking, We are hopeful that we can achieve a solution that will free up the on-street parking so the small lodge owners in the immediate vicinity will have adequate on-street parking for their guests. Sincerely yours, PH:ks " ~ ORDINANCE NO. <:;; ':) (Series of 1990) AN ORDINANCE AMENDING ARTICLE 10 OF CHAPTER 24 OF THE 'MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, BY EXPANDING THE AUTHORITY OF THE BOARD OF ZONING ADJUSTMENT TO GRANT VARIANCES FOR CON- STRUCTION STAGING AND TEMPORARY STOllAGE. WHEREAS, any use of land within the City of Aspen'not specifically listed in section 2, Article 5 of Chapter 24 of the Municipal Code, to wit, "Zone Districts, Permitted Uses, Condi- tional Uses, Dimensional Requirements, Maximum Land Use Densities and Off-Street Parking Requirements", shall be considered a prohibited use; and WHEREAS, the temporary off-site storage of structures, building materials and equipment and the use of off-site land, lots or parcels for construction staging is not an approved land use under existing land use ordinances and is, thus, prohibited; and WHEREAS, problems of building density, confined construction sites, 'and ensuring adequate site-access often result in imide- q",c:~e construction storage and/or staging areas within any given construction site, or eliminate the availability of same on site; and WHEREAS, cramped and crowded construction sites present the potential for accident and injury to construction workers and may impede access to the construction site by public safety equipment in cases of emergency; and . , necessary by the Board of Adjustment to insure such restoration. section 4: section 10-106. "Conditions", of Article 10, "Variances", of Chapter 24 of the Municipal Code of the City of Aspen, Colorado, is repealed and reenacted to read as follows: Sac. 10-106. Conditions. The Planning Agency staff may n2commend, and the Board of Adjustment:may impose, such conditions on variances as are necessary to accomplish the goals, objectives and policies of the Aspen Area Comprehen- sive Plan and the terms of this chapter. All variances granted so as to permit the temporary off-site storage of materials, structures or equipment pursuant to building construction,or construction staging shall commence and terminate on dates certain as established by the Board of Adjustment and shall not relieve an applicant from obtaining all necessary building permits. section 5: section 10-107, "Expiration", of Article 10, "Variances", of Chapter 24 of the Municipal Code of the city of Aspen, Colorado, is amended at subsections A, "Expiration", and B, "Extensions", to read as follows: section 1{)-107. Expiration', A. Expiration. Unless vested as part of a development plan pursuant to section 6-207 of this chapter, and except as otherwise established by the Board of Adjustment, a variance granted under this article shall automatically expire after twelve (12) months from the date of approval unless development has been commenced as illustrated by the issuance of a building permit. B. Extension. The Board of Adjustment may grant a one time extension of a development order incorporating a variance for up to twelve (12) months. We at the Holland House, located on 720 So. Aspen St. feel that the city of Aspen has made ample provisions for parking in the Aspen parking Garage, which has room to spare! There is even transportation via the Galena St. shuttle to the Ritz construction site. We at the Holland House do not want to see the neighbor hood become a parking lot, or a construction storage site.
