BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state
your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

plans dated 2/26/91 indicate an approximate 27% driveway slope.
Ordinance No. 76 (Series 1990), passed by City council 1/14/91
states: "No driveway shall exceed a maximum slope of twelve (12)
percent within twenty (20) feet of the property line bordering a
public or private right-of-way." (Section 19-101(h)) As well as
Chapter 24, section 5-302(A) of the Aspen Municipal Code.
Applicant appears to be requesting a 27% slope which would be a
15% slope variance.

DEAR SIRS,
WE ARE REQUESTING A VARIANCE REGUARDING THE DRIVEWAY OF 824 E.
COOPER AVE., LOT Q, BLOCK 111, CITY AND TOWNSHIP OF ASPEN,
COLORADO.
THE PROJECT CONSISTS OF A NEW ADDITION BEING ADDED ONTO AN
EXISTING HISTORIC COTTAGE. THE PROJECT BEGAN PROGRESSING
THROUGH THE HISTORIC PRESERVATION REVIEW PROCESS ON JUNE 13,
1990 AND WAS APPROVED FOR CONCEPTUAL REVIEW ON NOVEMBER 14,
1990. DURING THAT TIME ALL CODES, REGULATIONS AND LIMITATIONS
WERE VERIFIED WITH REGARDS TO THE PROJECT. SPECIFICALLY, ON
SEPTEMBER 7, 1990, CHUCK ROTH VERIFIED THAT A Sl-SLOPE ON A
DRIVEWAY WAS SUGGESTED BUT NO AN INFORCABLE LAW, HOWEVER,
SLOPING A DRIVEWAY A MAXIMUM OF 30 INCHES IN THE FIRST 10 FEET
WAS A ZONING CODE AND MUST BE MET.
AFTER CONCEPTUAL APPROVAL IN NOVEMBER WE WERE ABLE TO BEGIN
THE CONSTRUCTION DOCUMENTS AND FINALLY SUBMISSION TO THE CITY
FOR A BUILDING PERMIT ON FEBRUARY 26, 1991. SINCE THEN WE HAVE
BEEN INFORMED THAT AN ORDINANCE WAS PASSED ON JANUARY 14, 1991
LIMITING A DRIVEWAY SLOPE TO 6%.
A GREAT DEAL OF TIME AND LABOR HAS BEEN INVOLVED WITH THE APPROVAL
OF THE DESIGN, THE CONSTRUCTION DOCUMENTS AND IN THE BIDDING
PROCESS. HAD WE KNOWN THAT AND ORDINANCE WAS GOING TO BE MADE
WE CERTAINALLY WOULD HAVE WORKED WITH THE CITY ENGINEERING
DEPARTMENT TO OBTAIN APPROVAL BEFORE THIS WAS ENACTED - KNOWING
THAT THIS PROJECT HAD GONE THROUGH A LENG~HY APPROVAL PROCESS,
THE DRAWINGS WERE BEING COMPLETED AND THAT THEY WOULD BE SUBMITTED
TO THE BUILDING DEPARTMENT IN THE VERY NEAR FUTURE.
WE APPRECIATED YOU REVIEWING THIS APPEAL FOR A VARIANCE. WE FEEL
THIS WOULD BE A MINIMAL VARIANCE. THE DESIGN IS SIMILAR TO
MANY OTHERS IN THE NEIGHBORHOOD. IN FACT, ONE LOT AWAY ARE FOUR
NEW TOWNHOMES WITH VERY SIMILAR CONDITIONS. WE DO NOT FEEL WE
ARE ASKING FOR A SPECIAL PREVILAGE. THE DESIGN OF THIS PROJECT
WAS DEVELOPED ACCORDING TO CODE. THE ORDINANCE WENT INTO EFFECT
ONLY ONE MONTH BEFORE THE DRAWINGS WERE SUBMITTED. WE WOULD LIKE
TO BE ABLE TO CONTINUE THE PROJECT IN A TIMELY FASHION WITH THE
THE DESIGN WISHES OF THE OWNER AND AS APPROVED BY THE HISTORIC
PRESERVATION COMMITTEE.

TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, COlorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state

Ordinance No. 76 (Series 1990), passed by City Council 1/14/91
states: "No driveway shall exceed a maximum slope of twelve (12)
percent within twenty (20) feet of the property line bordering a
public or private right-of-way." (Section 19-101(h)) As well as
Chapter 24, section 5-302(A) of the Aspen Municipal Code.
