BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the zoning ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, you are urged to state
your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

Re: Variance Request for lot 8 Eastwood Subdivision
Dear Bill,
The proposed variance request is for the Conforti/Ortega
property and reads as follows.
The owners request a 7.3' front yard setback variance for the
purpose of constructing a 22' X 30' two story structure containing
a garage, entry and enlargement of the existing kitchen on the
first floor and attic-workroom on the second floor.
Special conditions and circumstances:
1) This structure was erected in Eastwood subdivision prior
to Eastwood's annexation by the city of Aspen in 1989. Prior to
annexation the front yard setback was 30' from the center line of
Eastwood Road. Upon annexation the front yard setback was increased
to 45'
2) The topography of the parcel and the proximity of the side
yard setback lines cause unnecessary hardship and practical
difficulties for the applicants by prohibiting construction of the
proposed structure in any other location than shown on the
improvement map.
3) The dimensions and location of the structure should be
within the minimum requirement regulation.
Rights commonly enjoyed by parcels in the same zone:
1) Of the 29 dwellings in Eastwood subdivision, 16 have
garages, 6 of these appear not to conform to existing front yard
setback requirements. All but three are two or three car garages.

The applicants respectfully submit that special conditions
and circumstances exist on this parcel and also that granting the
requested variance will not confer on them any special privilege.
