BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

Re: Zoning Front yard Setback Variance Request in the
R-15 Zone 1104 Waters Avenue.
Honorable Members of the Board of Adjustment:
The purpose of this request is to seek a variance for I
a triangular section on the west portion of our residence
for a proposed one car garage which would encroach into
the front yard setback a total of 8'.c ': R-15
zoning requires a 25' front yard setback.
When the house was built twelve years ago we already
recognized the problem with our lot as being under-
sized in relation to the 100' required setback from
the river.Tb.i,s had to have a special stream margin
exemption which placed the house 37' from the center
of the river which is our property line and only 14'
from the 100 year high water line. As a result of this
restriction the house was placed in its present location.
We respectfully submit that this has caused a unique
hardship and practical difficulty on the property, in
planning and building a small garage addition which
has been incorporated into a new entrance design that
is being built.
The entrance enlargement has been necessitated by the fact
that the foundations on the west have been sinking a
number of inches since the house was built. We hope
with proper drainage and depth on new foundations to
remedy this with the new entrance and garage addition.
This will be placed six feet west of the present
foundations.
We have received stream margin review exemption and Park's
Department approval for a number of small tree removals
for the driveway.

The attached plan shows the site plan and proposed
changes on our remodel.
,
I respectfully request that the board recognizes
the difficulty of the unique site and the consequent
hardship encountered in the 25' front yard setback
a~cl 37' had to be used on the rear yard (river side)
when ordinarily this would have required only 10'
with a normal lot not on the river.
