REOUEST FOR VARIANCE
The Applicant, Harley Baldwin, is the owner of the real
property described on Exhibit A attached hereto (the "Property"),
also known as the Collins Block, located on the southeast corner
of Mill street and Hopkins Avenue. On July 25, 1989, Bill Drueding
of the Aspen/Pitkin zoning Department rejected the Applicant's
request to accept his proposed open space location based upon
failure to meet the Minimum Frontage portion of the definition of
Open space set forth in Article 3 of the Land Use Regulations of
the Aspen Municipal Code (the "Code"). Therefore, the Applicant
is requesting a variance from the dimensional requirements
established for the Minimum Frontage applicable to open space.
This variance is requested because of the unique circumstances
involved in the renovation of the Collins Block. As indicated on
the plans attached to this application, a portion of the Property
has been designated as open space to satisfy the open space
requirements imposed by the City of Aspen due to the redevelopment
of the Property. The area provided complies with all aspects of
the definition of open space contained in the Code except for the
minimum frontage requirement.
The minimum frontage provisions of the Code require that the
open space shall have a minimum frontage on the adjacent street of
one-half of the length of the property on that side of the building
site or one hundred feet, whichever is less. The length of the
Property lot line along Hopkins Avenue is ninety feet, thus the
open space would, according to the Code, require forty five feet
of street frontage. If such requirement were strictly enforced,
a portion of the Collins Block building, which is listed on the
National Register of Historic Places, would have to be demolished,
for the forty five feet of frontage extends fifteen feet into the
building itself. As Applicant would be prohibited from demolishing
the building, the strict application of the dimensional
requirements of the open space provisions would work an extreme
hardship on the Applicant. In other words, the Applicant is
required to provide open space, but because of the nature of the
existing building on his Property, he cannot provide open space
with the minimum frontage required.
Therefore, the Applicant requests a variance from the minimum
frontage requirements so that the existing frontage of the open
space, which is approximately 7.75 feet, may serve as, and satisfy
the requirements of, the minimum frontage requirements of the Code.
The grant of this variance would be consistent with the Aspen Area
Comprehensive Plan in that it would preserve the character of
downtown Aspen by allowing an historic building to remain in place
while permitting the Applicant to dedicate the open space required
by the City to be dedicated. Further, if the strict provisions of
the Code were applied to the Applicant, it would work a severe
hardship for it would make it impossible for Applicant to satisfy
his open space requirements by the dedication of land, and, as

discussed above, the fact that the Applicant's property contains
a National Historic Register building creates special conditions
which are unique to Applicant's property. Because the conditions
are so unique, the grant of this variance will not confer any
special privilege upon the Applicant, it would simply achieve the
result all parties wish to achieve, namely, the preservation of a
National Historic Register Building and the dedication of open
space in the heart of Aspen.

TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, city
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
