HomeMy WebLinkAboutlanduse case.boa.625eastmainst.009-85 ('~ NOTICE OF PUBLIC BEARIN"''"' ~.J .~ CASE 85-9 BEFORE TBE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Off icial Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the Council Room, City Hall, Aspen, COlorado, (or at such other place as the meeting may be then adj ourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 24, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. Main St., Aspen, CO (Playhouse Theater) Description: Block 98; Lots 1/3 D, E, F, G Variance Requested. One free-standing sign to be placed on the Entry Canopy is proposed to identify the building and business, and this sign will conform to Sign Code requirements (2'-9" X 3'-6" = 9.625 square feet). However, because of the nature of the theater business, which is not adequately addressed by the sign code, the marquis. which are required to advertise the films currently playing exceed 20 square feet. Three standard single sheet marquis are proposed in the location of the existing marquis, for a total marquis area of 32.66 square feet for which we request a variance. It should be noted that the two existing marquis are oversized and constitute an area of 26 square feet and therfore the new marquis represent only a modest increase. 24-5.10 (2) limits all sinage for a property to 20 square feet. To whom is may concern: I have received your notice and memorandum for the variance for a free standing sign on the Playhouse Theater. As owner of the property at 629 East Main Street and being the property owner most affected by this variance, this letter will serve as my notice that I do not support the variance for the following reasons: 1. My understanding is that there will be a free standing sign located above the building eave and roof of the principal building. As my house has a deck on top, my concern is that my view from my roof-deck would be obstructed. 2. As for the wall sign on the building, I am not sure exactly how this would look and whether this wall sign will be lighted. 3. As for the projecting sign, again I have a difficult time visualizing how this sign will appear on the building. Basically, my non-support for the zoning variance results from not being able to visualize or understand what is being requested. Main Sign Variance The building is located in the C-l zoning category. Section 24-5.5(b) states, "Projecting signs shall not be higher than the building eave or parapet wall of the principle building." Applicant appears to be asking for a sign above the building eave. Section 24-5.10(2) states, "In no case shall the aggregate sign area for anyone use or anyone frontage exceed twenty (20) square feet." Applicant appears to be requesting a variance to exceed this by 22.26 square feet. Section 24-5.10(c) states, "Wall sign shall not exceed ten (10) square feet on any building wall." Applicant appears to be requesting a wall sign variance to exceed this by 12.66 square feet.
