consideration to the opinions of surrounding property owners and

ARTICLE 9 - NON-CONFORMITIES
Sec. 9-101.
Purpose.
within the Zone Districts established by this chapter, there
exist uses of land, buildings and structures that were lawfully
established before this chapter was adopted or amended which
would be in violation of the terms and requirements of this
chapter. The purpose of this article is to regulate and limit
the continued existence of those uses, buildings, and structures
that do not conform to the provisions of this chapter or any
amendments thereto.
It is the intent of this article to permit these nonconfor-
mities to continue, but not to allow nonconformities to be
enlarged or expanded. The provisions of this article are
designed to curtail substantial investment in nonconformities in
order to preserve the integrity of the Zone Districts and the
other provisions of this chapter but should not be construed as
an abatement provision.

Dear Charlie:
This coming Thursday is the meeting at which you will continue
the Gregory Boelens case. I thought I should write you to let
you know the circumstances of his not putting his sign up in time
for the 10 day notice for this week's meeting. It really was
partly my fault. Perhaps he should not have to wait a whole
month to be heard.
I am not trying to make excuses. As you know I have been doing
this now for 2 and 1/2 years. In that time I have never
notified any of the applicants of the date of their variance
hearing. I always send Bill Drueding a copy of the notification
that goes out to the surrounding property owners so that he knows
they go out. And since the applicants deal directly with him I
figured that's how they knew when their hearings were to take
place.
Also most of the time they have either an attorney or an
architect doing the whole thing for them and they alwa~s call me
for their dates. Well, Mr. Boelens is doing his on h1s own and
didn I t know to call me or Bill and since I had never been
instructed to call the applicants I did not call Mr. Boelens.
Another thing is that there are 2 more cases I have been told
about coming up which may get here in time for the 23rd meeting
and it may be a good thing to get this one out of the way.
