BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Roo~, City
Hall, Aspen, Colorado, (or at such other place as the mee~ing may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from thE
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance aTe invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

RE: Request for Variance - Volk Property
Dear Bill:
You will please find enclosed herewith an Application for
Variance relating to the wooden storage shed situate on the Volk
Property. Accompanying the Application is our application fee in
the amount of $10.00, together with addressed, stamped envelopes
for mailing notices to the necessary adjoining property owners.
At this point in time, we would respectfully request that
you consult with the City Attorney regarding the matter of the
constitution of the Board of Adjustment relating to this variance
application. We are informed that the action in red tagging the
property was based upon the insistence of Remo Lavignino who is
the Chairman of the Board of Adjustment. Our concern is in-
ability to obtain a fair hearing of a board constituted of Mr.
Lavignino, and others who have regularly worked with him on this
Board, some for over twenty years. I have personally heard him
say in a recent public meeting that he views members of the Board
of Adjustment as having a duty as individuals, outside of their
Board duties, to act as informants with respect to zoning matters
which appear to be improper. Given the constitution of the
Board, we would request that there be a special Board of
Adjustment appointed for purposes of hearing the Volk Application
at which no member, regular or alternate on the present Board of
Adjustment, be permitted to act in an official capacity.
One final item is the availability of the volk interest in
terms of setting a hearing on the Variance Application. Denice
Reich will be handling this matter for the benefit of the remain-
der of the family members. She is normally in Aspen only during
the summer and I would appreciate it if you could call me to
discuss possible schedulings in late June or August which will
coincide with her availability.

Below, please describe clearly, the proposed variance, including
all dimensions, and justification for the variance. (Additional
paper may be used if necessary.) The building permit application
and any other information you feel is pertinent should accompany
this application, and will be made part of this case.
Variance is requested for a small wooden, storage shed shielded
by mature Colorado blue spruce and vegetation situate within 5'
rearyard setback (per complaint and red tag issued by Zoning
Enforcement Officer predicated a complaint of Remo Lavignino)
required in the R-15 zone district. Shed does not impede views
of adjacent properties. The shed replaced a pre-existing metal
shed which had been situate in roughly the same location for many
years which had deteriorated to a very unattractive condition.
The wooden shed is a much more attractive structure than the one
it replaced. The rearyard of the Applicant's property backs up
on a tall residential structure, the view and orientation of
which is not towards the Applicant's property. The shed is
placed between large spruce trees (30') in a manner which is
least obtrusive to neighboring properties. To otherwise place
and orient the shed in any other manner would require removal of
these trees. The adjoining property owners to the east agree
that the location is appropriate. The granting of the variance
will not confer upon the Applicant any special privilege denied
by the Aspen Area Comprehensive Plan and the terms of Chapter 10
of the Land Use Code of the City of Aspen-to other parcels,
buildings or structures in the same zone ~istrict. Lot is small
for zone district thereby making siting of the facility
difficult. Shed facility is placed on lots in least obtrusive
location. Property is further subject to stream margin
limitation which does not allow the location of any structure
closer than 100 feet from the edge of the stream (Roaring Fork
River) unless certain conditions are met. Applicant has sighted
the the structure so as not to be visible from public trail
easements on south side of the stream. Applicant asserts that it
is not unusual for small storage shed structures to be situated
on lot edges and that the same are not offensive or contrary to
the purposes of the Aspen Area Comprehensive Plan. To deny
Applicant this application would deprive Applicant of rights
denied commonly enjoyed by other properties in the same zone
district.
