TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

SUMMARY
The Dittmers variance should be granted for the following
reasons:
1. The pergola is similar to an uncbvered porch that is
not restricted;
2. The pergola does not add "bulk" to the residence;
3. The pergola will improve the aesthetics of the
residence;
4. The pergola will improve the aesthetics of the
neighborhood;
5. The pergola will assist in energy conservation; and
6. The request is essentially a landscaping request and
granting the variance is consistent with the Code.

Variance Request
Mr. and Mrs. Thomas H. Dittmer and the D.I.T. Trust (the
"Dittmers") hereby request a variance from the City of Aspen
Board of Adjustment. The variance is necessary so that the
Dittmers may erect a "pergola" on the south and east sides of the
existing house located at Lot 2, Pitkin Reserve Subdivision, 0064
Pitkin Way, Aspen, Colorado (the "residence"). A pergola is very
similar to a trellis in that it is an open framed structure used
as a support for climbing plants. In essence, the Dittmers'
desire to erect certain columns around the south and east sides
of the residence with open rafters, which will create a place for
vines and other vegetation.
The attached improvement survey dated, June 16, 1987,
illustrates the location of the proposed pergola. Because the
pergola extends slightly beyond the building envelope on portions
of the south and east sides of the residence and because the
Building Department took the position that the request increased
the floor space of the residence beyond the allowable FAR, the
Building Department denied the Dittmers' request for a building
permit on the property. However, as will be discussed in detail
below and as stated in letters submitted by Steve Hansen of
Hansen Construction and Michael Lipkin, the pergola does not add
"bulk" to the residence. Moreover, because the pergola is
similar to an uncovered porch, its construction may not be
restricted. Finally, the pergola will accomplish the following:
(1) improve the aesthetics of the residence; (2) improve the
aesthetics of the neighborhood; (3) assist in energy
conservation; and (4) the granting of the Dittmers' request is
consistent with the zoning laws and the spirit and intent of the
Aspen Municipal Code (the "Code") concerning applications for
variances.
The actual plans for the pergola are included with this
request. You will note that the pergola is an open, airy
addition to the house. It is not a dwelling area. It is, in
essence, an uncovered porch, slab or patio, which is not
restricted pursuant to Code Section 24-3.7(f). The reason that
the pergola is akin to an uncovered porch is because the pergola
does not offer any protection from the elements (i.e. rain or
snow). In short, the pergola is a landscaping addition that will
be used to support plants. Therefore, because of its close
association with an uncovered porch, erection of the pergola
should not be restricted.
The pergola will give the residence a much more aesthetic
appearance. Mr. Lipkin's comments and urging that the Board
grant the Dittmers' request is noteworthy from the perspective
that Mr. Lipkin owns the residence to the east of the Dittmers
(as well as the vacant lot to the west), which is the only
direction in which the pergola extends toward another residence,
and if anyone possibly could be concerned that the pergola
extends too close to the neighboring residence, it would be Mr.
Lipkin. Furthermore, Mr. Lipkin notes that the pergola will not
alter or destroy the community plan. This is an important factor
when considering a variance. See, Greenwalt v. Zoninq Board, 345
N.W.2d 537 (Iowa 1984). See also, Steve Hansen's letter
regarding the aesthetic improvement to be gained from the
pergola.
The Dittmers are cognizant of the admonishment in the zoning
board appeal information that the Board "rarely" finds practical
difficulties or unnecessary hardship where the appeal is a matter
of aesthetics or design or economics, and in this regard, the
Dittmers submit that their request is more than aesthetics.
However, it should be remembered that aesthetics are worthy of
consideration by the Board. After all, as stated in Connor v.
Universitv Park, 142 S.W.2d 706 (Tex App. 1940), harmonious
appearance, appropriateness, good taste and beauty displayed in a
neighborhood tend to conserve value of property as well as
fostering contentment and happiness among landowners.
Because of the proposed height of the pergola, it does not
fall within the strict or literal definition of a fence, as that
term is defined by the Code. In this regard, other than Mr.
Lipkin, the neighbor to the east, the only other persons who
could even see the pergola would be passersby on the Rio Grande
trail. First, it is noteworthy that the Rio Grande trail is
approximately 95 feet from the pergola, at its closest point.
Second, the pergola is some 30 feet closer to the residence than
the "flagstone patio" to the south of the residence, it
encompasses a much smaller area than the flagstone patio and most
of the pergola overlaps with the flagstone patio, which is
already in place. Third, when viewed from the Rio Grande trail,
which is at a much lower elevation than the Dittmer residence,
the pergola will appear to be nothing more than a vine fence.
Finally, when viewed from the Rio Grande trail, the pergola does
not appear to add any visible bulk to the residence. In short,
the Dittmers submit that if the Board does not consider the
pergola to be an uncovered porch (which is not restricted by the
Code) certainly the pergola is more like a fence than a dwelling
area and given this fact, the variance should be granted in order
to satisfy the spirit and the intent of the Code.

In the summertime, aside from its aesthetic value, it is the
Dittmers' belief that the pergola will create some relief from
the heat of the southern exposure. See also, letters from Steve
Hansen and Michael Lipkin. This translates into energy
conservation, which is an important goal of our zoning and land
use laws. In this regard, it is noteworthy that the width of
exterior walls may be subtracted from the floor area, under
certain circumstances, if the walls are used for energy
conservation. Also, the Pitkin County Land Use Code excludes
certain solar energy devices from the definition of FAR,
therefore, implying that energy conservation devices should not
be included in FAR. Consequently, because of the energy
conservation value of the pergola, denying the Dittmers' request
would constitute an unnecessary hardship and undermine the
purpose and intent of the Code.
As stated in Ames v. Pasadena, 334 P.2d 653 (Cal. App. 1959)
variances should be granted when they are not detrimental to
public welfare and convenience, are necessary for the enjoyment
of a property right and are not detrimental to the property or
improvements of others. The Dittmers truly believe that this
improvement will add to the aesthetics of the area particularly
from the Rio Grande trail. It certainly will not be a detriment
to the public welfare. The natural foliage which the Dittmers
plan to grow on the pergola will add to the overall beauty and
nature of the area. Certainly, no one can argue with the fact
that one of the purposes of the Code is to maintain the natural
beauty of Aspen. Finally, the pergola is not detrimental to the
property or improvements of others. See, letter from Mr. Lipkin.
Consequently, the variance should be granted.
The extension of the pergola beyond the building envelope is
minimal and it does not add FAR from the perspective that it will
not increase the dwelling area of the house. This is, after all,
an open landscaping structure or an uncovered porch which may not
even be restricted pursuant to the Code. In this regard, members
of the Board are encouraged to contact, Michael Lipkin, Steve
Hansen or Ted Gardenswartz to view the property at their leisure
and to see the actual location of the pergola from all of the
surrounding areas.
Including the pergola within the FAR requirements would
deprive the Dittmers of the opportunity to make their home (l)
more energy efficient; (2) more enjoyable; and (3) more
aesthetically pleasing to the public. As noted above, because of
the open porch nature of the pergola and its energy conversation
benefits, the pergola does not even fall within the scope of FAR.
Moreover, although there are some structures involved, as can be

seen from the survey and the attached plans, this request is
essentially a landscaping request that will enhance the goals and
policies of the City of Aspen. Accordingly, the Dittmers'
request that the Board of Adjustment grant them the requested
variance to bui~d.a/~ergola.

To whom it may concern:
I have been advised of Mr. and Mrs. Thomas H. Dittmer's
request for a variance to enable them to build a pergola on the
south and east sides of the residence located at Lot 2, Pitkin
Reserve Subdivision, 0064 Pitkin Way, Aspen, Colorado. Hansen
Construction Inc. was the general contractor during the
construction of the residence.
After reviewing the June 16, 1987 improvement survey which
illustrates the location of the proposed pergola and the plans
for the proposed pergola, it is my opinion that the proposed
pergola will create a more aesthetic appearance. This is
especially true from the Rio Grande trail. Also, from the
vantage point of the Rio Grande trail, the pergola will not add
any appreciable bulk to the appearance of the residence. In this
regard, it seems to me that during the winter the pergola will
appear to be nothing more than a fence and during the summer the
pergola will be a place for plants and vegetation and it will
assist in energy conservation. This will provide much needed
shade from the southern exposure and it will allow the house to
blend in with the natural surroundings.
In short, I strongly encourage the Board to grant the
Dittmers' variance request.

To whom it may concern:
I have been advised of Mr. and Mrs. Thomas H. Dittmer's
request for a variance to build a pergola on the south and east
sides of the residence located at Lot 2, Pitkin Reserve
Subdivision, 0064 Pitkin Way, Aspen, Colorado. My company was
the architect for the original construction. Accordingly, I am
aware that with the addition of the proposed pergola, technically
the residence slightly may exceed the allowable FAR. However, it
is my opinion that the pergola is more akin to a landscaping
addition than conventional FAR dwelling space and that the
pergola should not be restricted because, in essence, it is an
uncovered and unprotected porch. Furthermore, I do not believe
that the pergola adds any "bulk" to the house. I say this not
only in my professional capacity as an architect, but also as the
adjacent landowner to the property.
I am the architect for the house on the east side of the
Dittmers' residence and I have discussed the requested variance
with my clients and they support the Dittmers' request. In
addition, I personally am not opposed to the pergola. In fact, I
welcome the addition of the pergola from an aesthetic point of
view as well as a privacy point of view. I believe that during
the spring and summer, the natural plants and vegetation on the
pergola will provide the Dittmers with additional privacy and
will beautify their home and, consequently, our neighborhood. In
this regard, I believe that the pergola is consistent with the
community plan.
Finally, as an architect, I am keenly aware of the Code's
efforts to encourage energy conservation. I believe that the
southern exposure of the Dittmers' residence in the summer makes
this portion of the house uncomfortably hot and the pergola will
rectify this situation and result in an energy savings by the
Dittmers.
In short, I enthusiastically support the pergola and I urge
the Board to grant the Dittmers' variance request.
