BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged ~o
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

and thus this area is non-conforming structure. Chapter 24, Sec
9-103B. No non-conforming structure shall be enlarged that
increases its non-conformities. Applicant appears to be ask ing
to enlarge a non-conforming structure requesting approximately 5
ft to 20 ft encroachment variance front yard.

DESCRIPTION OF-PROPOSED EXCEPTION SHOWING JUSTIFICATIONS
Owner desires to change angle of exterior front wall/roof from approximately 300 to
perpendicular and enclose exist~ng deck allowing addition of 150+ square feet of
building area. Variance is necessary because building built in 1955, violates front,
yard setback of 25'. See q,ccompanying improvement survey. Site has topographic con-
straints and request doesn t change exist1ng improved footprint. Because house sits
down from Riverside Drive, there will be no visual impact on neighbors. Front yard
setback variance just granted to neighbor to replace carport with a garage in front
yard setback after non-conforming carport in setback had replaced conforming garage
which was turned into living space. Front yard setback variance also granted for '
Wright residence on Riverside Dtive to allow attached garage. I Zoning ~s R-:15. . How- ,
ever, all lots are substandard in size (10-12;000 feet) thereby creating site constraints
,for virtually all lots in the subdivision. A permanent variance is sought.
