BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.
The particulars of the hearing and of the requested variance are

Near corner of Cemetery Lane and Power Plant Rd.
Variance Requested: property is located in the P(PUD) zoning
area. (Park) Definitions (page 3-10) Height. Antennas,
chimneys, flues, vents, or similar structures shall not extend
over the ten (10") feet above the specified maximum height limit.
Although the dimensional requirement are set by a PUD review, it
is my interpretation that the surrounding neighborhood sets the
standard. Max imum height is pl us lO ft. above the ex i sting
building. Variance to extend greater than 10 ft above the
existing buildings.

The Calarada Health Department and Enviranmental Pratectian Agency are requiring
that this tawer be installed in this lacatian as part af their requirements under
the new federal PM-10 regulatians. These agencies are requiring that we operate
the thermometer and wind vane on this an~enna for four and one-half months.
This lacation far the thermameter and wind vane is necessary and this lacatian
is the anly ane that meets the requirements af the EPA and Calarada Health
Department, which include the fallawing:
these weather sensars cannat be in the City where there are tall trees
and buildings. It requires apen space ta prevent interference with
wind measurements.
they cannat be an tap af a narmal building which is heated, since the
heat fram the building wauld interfere with the temperature readings.
they cannat be farther dawnvalley because wind speeds and directian wauld
be changed by winds draining dawn fram Maraan Creek, and because the
valley apens up sa much that winds characteristic af locatians near
dawntawn wauld nat be measured.
they cannat be away fram the center af the valley. Even a lacatian as
clase as the Maralt praperty failed ta meet EPA standards and be appraved
because it was tal' clase ta Shadaw Mauntain, where draining winds wauld
interfere with wind measurements.
In summary, the EPA and Calarado Health Department have such lengthy requirements
about distance toclosest trees, heights of nearby trees, distances to buildings
and hills and other obstructions, distance from,downtown, location relative to
side valleys, etc., that the thermometer and wind vane are limited ta this specific
site. It was not possible to find another site either in town or in a more remote
lacatian that wauld be an acceptable site.
The Enviranmental Health Department cammits ta remaving the thermameter and wind
vane as well as the antenna they are an, by April 1, 1989.
We have spaken ta the mast-impacted neighbar and explained to him bath the
temporary nature of the antenna, and the reasons requiring it to be located here.
All adjacent landawners will be notified af the request as part af the
application process.
