Dear Mickey:
At your request, I have reviewed the Board of Adjustment file and
meeting minutes associated with a 1988 variance application
pertinent to the above-noted parcel. I have also discussed the
matter at some length with Bill Drueding of the Zoning Depart-
ment. Based upon my study of all of the information made avail-
able to me, I can provide you as follows.
A variance request relevant to the subject parcel was submitted
to the Board of Adjustment on October 27, 1988, seeking permis-
sion to utilize R-6 'zoning category setback dimensions to the
property in place of the R-15 setbacks applicable thereto. The
variance request was heard by the Board of Adjustment at a public
hearing conducted on November 10, 1988 (Case No. 88-10). The
variance was granted. No additional variance was granted, howev-
er, to allow for an encroachment into the R-6 setbacks.
It has now come to the city's attention that due, probably, to a
construction error, a very small corner section of the home
subsequently constructed on the subject parcel intrudes'into the
five foot (5') side-yard setback by approximately eight inches
(8"). The city assumes that this minor intrusion was uninten-
tional and is of such a nature as to warrant no action by the
City in regard thereto. Hence, while the City cannot speak for
adjoining property owners, this is to advise you that no enforce-
ment action will be taken in regard to the minor encroachment as
herein identified.

Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City

Addendum A to that Vacant Land Contract To Buy
And Sell Real Estate dated August 16', 1988,
By Peter Coventry and/or assigns, Purchaser,
for the purchase of
Lot 5, Ute Addition, Pitkin County, Colorado
1. Purchaser shall apply and pay for the necessary
variance and requisite architectural work in the most
expeditious way possible. Seller shall have the right
to check on progress with the Building Department or
any agent hired by Purchaser at any time. In the event
said variance has not been obtained by October 10,
1988, Purchaser may, at his option, either close the
transaction within five business days or declare this
contract null and void and all things of value shall be
returned to Purchaser.
2. Seller shall pay for the above named plans as presented
to Purchaser. Purchaser to pay for completion of plans
as well as pay for and expeditiously submit the
necessary variance application for said plans.
3. Coates, Reid and Waldron advises all parties concerned
of their right to seek legal counsel on any and all
aspects of this transaction.
4. Pursuant to the Colorado Real Estate Commission Rule
E-35, Purchaser hereby acknowledges prior, timely
receipt of notice that Coates, Reid and Waldron is the
agent of the Seller and is not representing Purchaser
as Purchaser1s agent in this transaction.
5. All earnest monies are to be placed in an interest
bearing account with interest accruing to the benefit
of the Purchaser. Purchaser's Social Security Number

6. Pursuant to Ordinance 20, Series 1979 of the City of
Aspen, a Real Estate Transfer Tax 1n the amount of
one-half of one percent (1/2 of 1%) of the purchase

TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to Pitkin County Resolution of June 5, 1955, as
amended, a Public Hearing will be held in the District Court-
Room, Pitkin County Court House, Aspen, Colorado, (or at such
other place as the meeting may then be adjourned) to consider an
application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the County Zoning
Resolution.

Dear Sirs:
This note is to infonn you that, as owner of K-l04 at the GANT which is located
so as to face lot 5, ute Addition, I am strongly opposed to the gr~nt of a
variance to Mr. Wm. Hewitt. It is clear that ahe houses built in the ute Addition
are much too large in relation to their lot sizes. I am very unhappy about the
damage they have done to my view of the mountains, especially about the way that
they have cut off the Continental Divide from my sight at K-l04. This was aJl!8rently
approved by the zoning board. Now it is requested that a variance be granted to
ena ble an even greater curta1lment of my outlook. A variance of this kind would be
most unfair to me and to others at the CANT. I see no justification for the

board to grant such a variance; this lOuld worsen my quality otife
reduce the value of my property in Aspen)for no obvious benefit to
and, incidentally,
the quality of
life in the citF.
As an hpen property tax payer for more than thirteen years, I respectfully ask you
