BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

clients' request for a review of the Building Department's
decision to deny our client building permits and application for
a variance from the Municipal Code provisions of the City of
Aspen:

An executed and complete appeal form;

Copies of the denied building permit application;
3.
A statement in support of the request for review of the
denial of building permits and appeal for variance;
4.
A complete list of neighboring property owners,
including stamped, pre-addressed envelopes to each; and

Applicant respectfully requests a va~iance from the floor area requirements for
duplexes to be built in the R/MF zone. The Municipal Code provision
(24.3.4(10)) setting forth the FAR for the'R/MF zone is unclear and
inaccurate. Applicant sought guidance in interpreting the Code provision from
the Building Department and Planning Office and, relying upon information
received from such city officials, authorized architectural drawings with a
1:1 FAR. If Applicant is not granted a building permit to proceed with its
development, Applicant will suffer unnecessary hardship.

I. INTRODUCTION
Pursuant to Article Two of the Municipal Code for the City
of Aspen (the "Code"), the undersigned Applicant hereby
respectfully requests that the decision by the Aspen Building
Department denying Applicant a building permit be reviewed and
reversed. If a variance is necessary to enable Applicant to
obtain a building permit to construct its proposed project,
Applicant further requests a variance which would allow the
external floor area ratio for Applicant's land to be 1:1.
II. FACTS
Applicant owns the property located at 820 and 822 East
Hyman Avenue (collectively, the sites comprise the "Property");
each lot is comprised of approximately 6,000 square feet.
Applicant wishes to construct one duplex on each of the two lots
(the "Project"). Prior to beginning the Project, Applicant
sought assistance from the Building Department and Planning
Office of the City of Aspen to ascertain the floor area ratio
("FAR") applicable to the Property. Applicant sought such
assistance for the Code provision, Section 24-3.4(10), which
purports to set forth the allowable FAR is unclear and
inaccurate. After numerous meetings with the Building Department
and the Planning Office, including meetings with Steve Burstein,
Alan Richman and Bill Drueding, in which all parties involved
stated the Code provisions were unclear and confusing, Applicant
understood that it had the right to build a 6,000 square foot
duplex on each site. In January, 1987, Applicant met with
Drueding to discuss the building plans for the Project and to

confirm the interpretation of the zoning regulations affecting
Applicant's property. Applicant's property is zoned R/MF whose
permitted uses include one-family, two-family and multi-family
dwellings as well as townhouses. Drueding asked for a site plan
to confirm that the open space and FAR requirements were met on
the Property.
On approximately January 6th or 7th, Applicant met with
Drueding and the architects who designed the Project and
presented a preliminary site plan to Drueding in order to get
preliminary zoning confirmation. Drueding confirmed the open
space, FAR and setbacks indicated on the site plans. Based upon
this meeting and the conversations which Applicant had had over
the preceding months with the Planning Office regarding the FAR
allowable on the site, Applicant authorized the architects to
develop working drawings for the project.
On March 18, 1987, Applicant applied for a building permit
which was subsequently denied based upon the finding by the
Planning Office that the allowable FAR was 3,600 square feet for
each site rather than the 1:1 ratio Applicant understood applied
to the Property due to previous meetings with the Building
Department and Planning Office.
III. DISCUSSION
Based upon reasonable reliance by Applicant on city
officials I interpretation of a confusing section of the Code,
Applicant authorized its architects to incur approximately
$75,000.00 worth of expense in preparing architectural plans for
the project. The Code (area and bulk requirements) states in

Section 24-3.4 that:
"The external floor area ratio for zone
R/MF is the same as for zone R-6." Such a statement is confusing
in light of the fact that permitted uses in the R/MF zone include
both multi-family housing and townhouses; uses which are not
permitted in the R-6 zone. It was because of this confusing gap
in the Code that Applicant first approached the Building
Department and the Planning Office for guidance in determining
the size of the dwellings Applicant would be allowed to build.
During the course of the meetings with these offices, the
Applicant was led to believe that the statement in the Code to
the effect that the external floor area ratio in an R/MF zone was
the same as in the R-6 zone was incorrect and that the external
floor ratio was instead 1:1 for all buildings in the R/MF zone.
Thus Applicant was told that on a 6,000 square foot lot it could
build a 6,000 square foot building. Applicant r~asonably relied
upon the city officials' interpretation of the Code. Based upon
such reliance, the Applicant authorized its architects to incur
approximately $75,000.00 worth of expense in preparing
architectural plans for the project. It was not until after
Applicant had incurred these large costs and applied for its
building permit that Applicant was told that the Planning Office
had decided that the external floor area allowed on Applicant's
property was 3,600 square feet instead of 6,000 square feet as
Applicant had been lead to believe.
Applicant respectfully requests that the Board of
Adjustment, pursuant to its authority, review and reverse the
decision of the Building Department by which it refuses to grant

Applicant a Building Permit. Applicant has suffered unnecessary
hardship in incurring the costs of the architectural plans and in
suffering the delays in the start of construction caused by the
refusal of the Building Department to grant a building permit to
the Applicant.
Applicant's proposed FAR, which is the basis of the denial
of the building permit, was determined only after numerous
conversations with city employees, and thus, if incorrect, such
inaccuracy does not result from actions of the Applicant.
Applicant would not have authorized Applicant' s architects to
proceed had it not believed it had clear direction from the City
as to the proper interpretation of the Code PAR provisions.
Therefore, if the FAR set forth in Applicant's architectural
drawings is incorrect and thus not allowed in the R/MF zone,
Applicant respectfully requests a variance allowing Applicant to
construct duplexes on the Property with an FAR ratio of 1:1. The
granting of this variance will not adversely affect the general
purposes of the comprehensive general plan, for the duplexes
Applicant proposes to construct are suitable for that
neighborhood and similar to other development in the area.
Furthermore, the construction of duplexes on the Property is a
less intensive use of the Property than Applicant legally could
make, for Applicant could construct multi-family housing on the
Property.

Since I am unable to attend the meeting of June 18,1987 I would like to express
my opinion in writing.
As a property owner on East Hyman Ave. I am against the variance requested by
Frank D. Ross. I prefer the zoning be left as is.

Dear Mr. Lavagnino,
RE: Case Number 87-8
Mr. Frank D. Ross
We are writing to inform you of our objection to the granting of a
variance in the above referenced case. Our objections are based On
the follOwing reasons:
1. The Applicant has plainly not shown a hardship in this case. As
I understand the procedures, neither financial hardship nor delays are
a consideration.
2. The request for a 6,000 square foot structure is not in conformance
with the City Code.
3. There are no pre-existing conditions attached to these properties.
4, Applicant purchased the property with the zpning in place, and
FAR in this zpne is clearly stated in Section 24-3.4, "Area and Bulk
Requirements", (page 1454) of the City Code.
5. Two large 6,000 square foot structures would not fit into the
general appeaaance and character of this neighborhood.
We have reviewed Section 24-3.4(10), "Area and Bulk Requirements," of
the City Code, and we find the requirement quite clear and accurate.
The City Code clearly states that for a Duplex Structure on a Lot Size
of 3,001 - 9,000 Square Feet, the Applicant has an Allowable Square
Foot of 2,700 - 4,500 with the calculation of 30 square feet for each
additional 100 square feet in lot area. A 6,000 square foot lot has an
allowable square feet of 3,600 (30SF!100SF X 3,000SF = 900SF + 2,700SF =
3,600SF).
If, indeed, the Building Department and Planding Department gave
inaccurate information to the Applicant as Applicant claims, this in
itself does not justify granting a variance. Mistakes can be made
but this does not relief the Applicant from having to build according
to the City Code. If the statement from the Building Department and
Planning Department was one mistake, another mistake of granting a
variance would not make a right. Until a Building Permit is iSsued
whatever mayor may not have been said between parties does not aarry
any weight,

In closing we believe the Applicant has neither demonstrated a valid
need for a variance nor any justification for granting a variance.
Therefore, we strenuously object to a variance in this case.
