BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pu rsuant to the Off i c ial Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

Dear Mr. Dreuding:
On October 31, 1986 as the representative of the Hotel Jerome I submitted plans
to the building department for perimeter fence on the south and west sides of the
Hotel property. The plans were denied because the fence height at certain points
exceeds six feet. Section 24-37 (c) requires that a fence shall not exceed six
feet above grade and where visible from the street shall be constructed of wood,
stone, wrought iron or masonry. The proposed fence meets the requirements for
materials because it will be wrought iron along Main Street and wooden along the
west property line and on the north side of the alley behind the Aspen Times.
Application is made herein to the Board of Adjustment for a variance for a fence
which, on the east end of the alley and on the north side to the wall of the
Hotel building, will have a height of from six feet to just over nine feet.
The Hotel Jerome property is unique in that it comprises the entire north half of
block 79 and the eastern 179 feet of the vacated alley and most of the southern
half of the block. The alley runs from Monarch Street behind Carl's Pharmacy and
the Aspen Times and dead ends after 100 feet. Addi tionally this property is
unique in that there is a grade change of over 3.5 feet between the south and
north portions and this occurs almost entirely at the alley.
The physical site presents two practical difficulties; one is that the alley
projects part was- into the property, and two, the ground drops awas- specifically
at the alley. We are requesting a variance in the fence height primarily for
hotel security. Given the building foot print, the site is secure except for the
alley off Monarch Street. Adequate lighting and security can be maintained at
the Main Street garden entrance, the Mill Street garden and the parking garage.
It is a reasonable and necessary request for the Hotel to provide, not merely
adequate, but complete security along the alley where the property is the most
vulnerable.
The garden will have an open swimming pool and access to many areas of the Hotel.
The management consultants and insurance carriers for the hotel both want a nine
foot fence along the alley. While a six foot fence is a deterrent it is easily
scaled, especially if it is stepped. while a higher fence is an absolute barrier

and will ensure that neither innocent pranksters nor serious felons will be able
to access the property.
Further it is reasonable that this quality, landmark lodging facility be
permi tted to construct a fence to screen the alley from the guest rooms in the
addi tion. This will screen the visible refuse generated by the Aspen Times and
Carl's Pharmacy and will deaden a large amount of the noise of early morning
activities in the alley. It is, it seems, an injustice to disallow a nine foot
fence in the alley where it will be invisible from any public street and serves
the purpose of allowing the full enjoyment of this unique plrcel.
Having determined the necessity and reasonableness of the variance requested the
board must judge the request on the basis of factors found in 2.22(d)(1 ),(2),(3)
and (4).
It is certain that this property is unique in that the alley is vacated through
6a;, of the block and projects into the remaining 40%. This extraordinary
circumstance does not apply to other properties in the vicinity and in
the commercial core zone. It is essential that the variance be granted to ensure
the rights of the hotel owners and guests to privacy, to peaceful enjoyment of
the property and for security of the grounds.
Finally, the granting of this variance will not adversely affect the purpose of
the comprehensive general plan. The Jerome garden is designed to be open and
attractive to the guests and general public of Aspen. Along Main Street
the wrought iron decorative fence is only three feet high and will have an
entrance gate to access the garden. The variance is requested for the fence
around the alley, out of view of the public and not in any way impeding
legitimate public access to, or enjoyment of, the Jerome public areas.
I respectively submit this letter, fee, eight copies of plans and information on
the neighbors wi thin three hundred feet. Please notify me of the hearing date to
allow me to comply with the other requirements in a timely fashion.

On November 25, 1986 the Historic Preservation Committee approved
a request to place a fence along the east end and north side of
the alley protruding into the Hotel Jerome property, the fence
was to vary in height from 6 feet to not more than 10 feet. HPC
found that the fence would have no adverse effect on the historic
character of the Jerome, and would be compatible with the architec-
ture of the existing hotel and the addition. This memorandum is
written at the request of HPC in support of the Hotel Jerome
request for a variance.
