TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELGV:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colorado,
(or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed var iance
are invited to appear and state their views, protests or objections.
If you cannot appear per sonally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to suc~
variance, as the Board of Adjustment will give serious consideration to

DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATIONS
This application is submitted at the recommendation of the
Building Inspector and Zoning Enforcement Officer. No
building permit has been applied for.
Because the house projects 12.45 ft. into the 15 ft. rear yard
setback and 1.67 ft. into the 6.67 ft. secondary front yard
setback it is classified by the zoning ordinance as a
IInon-conformingll structure. (See Site Plan) The projection
into the rear yard setback is not untypica1 of old Aspen
houses constructed prior to the contemporary zoning laws.
In 1974 a building permit was issued for remodeling work done
on a portion of the house, 24.29 ft. wide, which projects into
the yards as noted above. Included in this remodeling was the
finishing of attic space to create a sleeping room. The room
in cross section is a triangle with a base of approximately
1411-3" and a height at the center or apex of 6"-9". The room
is 23"-3 1/2" long and is accessed by a spiral stairway from
below. One dormer exists to provide natural light and
ventilation. The space is finished, furnished and has been
used as a sleeping area since its completion.
It is the intention of Marie Schneider to alter this sleeping
space to make it conform to current building code standards.
This is possible by raising the north portion of the roof to
provide a 71-611 ceiling in more than 50% of the useable space.
Although no additional floor area will be added, there will be
additional volume created where the building projects into the
setback.
The appeal for adjustment is made to overcome the non-
conformance with current building codes. The space is used,
and will continue to be used, however, the proposed alteration
will provide proper headroom, light, ventilation, and window
egress. Valid reasons for overcoming these practical
difficulties and unecessary hardships are supported by the

This case was presented to the Board of Adjustment
on 16 January 1986 for a variance request. At
that meeting it was tabled, subject to
reapplication, until the next hearing date in
February .
Please remove this case from the February Board of
Adjustment agenda. Should the owner decide to
proceed with a resubmission I will be in touch
with you so the matter can be rescheduled for a
subsequent hearing.
