NOTICE OF POBLIC HEARING Case t86-20 BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962; as amended, a public hearing will be held in the Council Room, City Hall, Aspen, Colorado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the zoning Ordinance, Chapter 24, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. J)v....,...,.-..,,-,Q 415 Pearl Court, Aspen oz::....,..J ~ Case #86-20, Request by Thomas welq: for variance for the Nitze house, 420 West North Street, Aspen TO: RE: We have not seen the plans for the addition to the Nitze house, but from the capsule description on the hearing notice would strongly oppose the granting of a height variance without further information. The Nitze house is directly south of our house. It is a massive house, quite high, and built close to the property line. As such, it already blocks much of our view toward Aspen Mountain. Construction of an addition with a roof 3-4 feet above the legal height - even a "much less massive" but presumably still massive addition - would further cut the existing views if it ~ located on the east side of the present house near the lot line, that is, at the northeast corner of the house. Such an addition (and raising of the existing roofline to match?) would create an extremely massive and oppressive structure as viewed from the north, e.g., from our deck or neighboring yards. We would strongly oppose such an overheight addition, or raising of the present roofline. Our objections would not apply as strongly to an overheight addition on the southeast corner of the Nitze house where their terrace is located pro- vided the existing roof was not raised, but other neighbors might have objections. We would strongly urge the Board to reject the requested variance at this time, and to require that detailed sketches of plans be made available to neighbors well before any subsequent request for a variance. .,.. ~ / KATHARINE THALBERG 434 WEST SMUGGLER. COLORADO 81611 1 November 1986 City of Aspen Board of Adjustment 130 Sou th Galena Aspen, CO 81611 Dear Persons: This letter is to state my objection to the proposed variance for the Nitze property at 420 North Street. My house, a Victorian at the above address, is surrounded by houses that presumably do rot exceed the height restriction but which totally block the views and which dwarf the Victorian houses rext to them. The houses of which I speak are two Butch Clark houses, one to the east of mine and one to the west, and the Finkel house which is across the street south of mine. I domt believe any consideration should be given by your board to any exceptions or variance to an already generous height restriction which, when taken advantage of in a massive structur~ can be excessive for the neighborhood. Nor do I think you should give consideration to such a request because it is accompanied by the threat that it "allows much less massive addition than alternate design." Since both alternatives would be massive, and one merely "less massive" than the other, your strict adherence to existing restrictions is essential. I sincerely hope that your decision will be made in the best interest of the neighborhood rather than the individual eicantlS desire to enlarge more than the code allows.
