Case t 86-17
BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, COlorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

JUSTIFICATION FOR PROPOSED EXCEPTION
Appellent is in need of additional exterior signage to
make the public aware of its location and existence in
the marketplace.
Due to Appellent's second floor location, which is not
on the customary uwalk-by" route of shopping visitors
or local residents, Appellent must advertise its location
and specific address extensively. Appellent feels that
its current signage is inadequate to aid in directing
potential clients to the advertised location. Appellent
also feels that signage should be clearly visible for
both vehicle operators and pedestrians.
Appellent requests additional awning signage in order to
identify the nature of its business, thereby avoiding the
current consumer and supplier misconception that Appellent's
business is an expansion of Smith's Clothing when, indeed,
it is a totally separate enterprise offering a different
type of merchandise and service to the general public.

Proposed size for one (1) exterior building sign to be displayed
on the West wall (Hunter Street side) is ten square feet.
Design of the sign is attached herein,
Appellent proposes to add two words to each of its two awnings.
The words are: HOME OUTFITTERS
HOME OUTFITTERS will be added to the existing awning signage
which currently says THE RANCH maintaining relative consistency
with the Appellent's logo design.

Dear Mr. Lavagnio:
Please be advised that I would like to see that all Aspen busi-
nesses are able to exercise every legal and ethical opportunity
to improve their business, because in the long term, all the
residents will benefit from a healthy business community.
However, I'm certain that the presently existing sign code for
Aspen businesses was thoroughly evaluated prior to its "going on
the books" and with the ever increasing number of businesses in
our small valley community I would be very reluctant to grant a
variance from a sign code which all businesses are required to
adhere to, unless of course, there are certain, unusual,
extenuating, circumstances in a specialized case. Since I do not
see such a situation here, I personally would be inclined to
"turn down" this applicant's request, i.e. I would object to the
granting of the request for variance.
