DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATIONS
The owners of the three ground floor units of the Tipple Inn
request a variance to construct a solar addition to the south side
of their units. This will extend 10 ft. from the building for the
58 foot length of the building or 580 square feet, of which the
first 5 feet or 290 sq. ft. are an existing walkway under the
overhanging balconies and roof, and will extend only 2 feet beyond
the existing railroad tie planter box.
The purpose for the request is two-fold: to significantly
reduce noise and to conserve energy through appreciable solar gain.
An unnecessary hardship and practical difficulty to the
residents of the units exists due to the relocation of the main
entrance of the Tippler bar and disco from the slope (opposite
or east) side to the southwest corner adjacent to our residences.
It is virtually impossible for the occupants to sleep before 2:30am due
to the boisterous noisy drinkers arriving and departing the disco
through the night. We experience shouting, singing, profuse pro-
fanity, bottles and glasses being tossed on our premises and even
inebriated men urinating against our bedroom walls. Letters are
enclosed from Thomas S. Dunlop, Director of Aspen-Pitkin Environ-
mental Health Department and Lee L. Miller, Manager of the Tipple
Inn Condominiums, as confirmation of the severity of the noise
hardship that has been created.
The proposed construction will reduce noise impact by one-half
and in addition will reduce energy use by 50%!

considerable solar benefit, the glass construction will reduce the
visual
bulk impact (see enclosed architect's rendering).
This request is the minimum variance which will effectively
accomplish the combination of noise abatement and solar energy
conservation and thus make possible the reasonable use of the land
and building.
The four valid reasons for granting this variance exist:
That the special conditions and circumstances
do not result from the actions of the applicant.
The conditions result from the Tippler bar
relocating its main entrance (previously on the
opposite side of the building).
That special or extraordinary circumstances
apply to the subject property that do not apply
similarly to other properties in the same vicinity
and zone: and that the granting of a variance is
essential to the enjoyment of a substantial property
right enjoyed by other properties in the same vicinity
and zone, but denied the subject property because of
the special conditions or extraordinary circumstances.
The Tipple Inn residents are the only residents in
the same vicinity being denied the right to sleep
due to living immediately adjacent to the relocated
Tippler bar main entrnace.

Dear Mr. Crawford:
This letter is intended to confirm our conversations concerning
noise generated from the Tippler. OVer the past several years
this office has responded to noise complaints generated from and
around the Tippler/Copper Kettle complex. Sources of noise have
varied from music generated from the Tippler to boisterous
behavior of people walking into, out of and past the Tippler.
Also, noise complaints have been received concerning the dumping
of trash and bottles into the dumpster serving the Tippler.
It is my understanding that you are in the process of evaluating
the installation of a greenhouse between the alley and your
condominium at the Tipple Inn. The purpose of the installation
is to buffer street noise from entering your living unit.
While such a structure may offer some relief from street noise, I
am not overly optimistic that the isolation you expect can be
ach i eved. There will, however, be a r educti on w hi ch may be
acceptable to you.

Dear Sirs,
Owners and guests of the Tipple Inn Condominiums have suffered
through significant and continuous noise problems generated by
the presence of the Tippler Bar/Disco.
Guest complaints have been primarily related to unruly behavior
of arriving and departing patrons to the bar until after 2 AM. In
addition, autombile starting/cranking noise, car doors slamming,
and traffic immediately adjacent to the bedrooms off the Tipple Inn
Condominiums cause significant disturbances.
Guest complaints have been severe to the point of guests checking
out early. In one recent weekend we had 3 unrelated parties check out
early due to their exasperation with the noise.
Any improvements to mitigate the noise problem would be welcome.

TO WHOM IT Mil Y CONCERN
The owners of the ground floor units of the Tipple
Inn Condominiums desire to construct a sunspace
enclosure on the south facing side of their units,
approximately eight feet high, ten feet deep and sixty
feet long. The building, however, is over the existing
Floor Area Ratio for its zone.
The Owners believe that they have a very real and
severe hardship that justifies construction of this
sunspace enclosure.
At their request, we have performed the attached
acoustical and thermal analysis to determine effects
achieved by the proposed addition.
By our calculations, acoustical intrusion from guests
leaving the adjacent Tippler nightclub is significantly
reduced. Additionally, thermal performance of "the units
is remarkably improved, reducing utility bills for these
units by one half annually.
We feel that this addition is reasonable, sensible and
needed for the continued comfort and enjoyment of the
owners of the ground floor condominiums of the Tipple
Inn.

BUILDING DESCF:IPTION
The Tipple Inn is located on the south-east carner of
Galena and Dean streets adjacent to the Tippler night club,
in Aspen~ CO. It is a three level condominium project with
porct18s on the south side facing the ski area.
FClr. the lower levels the primary construction materials
are brick and wood, the upper floors are conventional
franlirlg with built up roofing. The walls and foundations of

The nature of the brick with wood construction usually
dictates a leaky structure with ~egards to air infiltration,
however, the interior is finished with drywall thus reducing
the ",i,- chanqes per hour IACH).' The multiple unit
configuration also has a beneficial effect on the air
changes due to the decreased overall exterior surface to
volume ratio. The infiltration rate has been calculated at
.75 ?',CH.
SUNS PACE ADDITIONS
This project proposes the addition of sunpaces to the
lower level encompasinq three units of the Tipple Inn. The
purpose for t~le addition of these sunspaces is twofold. The

units created by the pedestrian traffic associated with the
Tippler rlightclub. This traffic creates noise well into the
night when the bar closes and also intrudes on the privacy
of the residents.

The second reason is to increase the energy efficiency
of ttl8 units, which have very low insulation levels in the
walls~ sub-code glass and also get very little sun.
Acoustical Privacy
Current noise levels from late night visitors to ttle
Tippler Night club invade the privacy of the first floor
residents causing sleepless nights. This noise level can be
as loud as 100 decibles with as much as 80 db being
transfered through the existing windows and wall. This is
comparable to a freight train at 100 feet.
The addition of the insulating glass in the SWlspace
would further reduce the noise level an additional 35 db, to
45 db comparable to a quiet residential area~ mal,ing the
interior environment suitable for sleeping, as the residents
are often trying to do at 2:00 am when the bar is closing.

Energy Performance
ComplJter analysis were performed before and after ttle
proposed addition o.f the sunspaces using the pr-oqram Sunpas
by Solar Soft on an Apple II plus.
The energy efficiency of the building can be

required to maintain a temperature of 65 degrees. T~jis is
in addition to heating needs met by solar gains or internal
gain ONT GAINS) such as ,from pE?ople, 1 iqhtill,j, etc.
As the building now stands the energy conSURlption for
the lower floor of the building, based on the previous
years fuel bills, was 114.7 MStus 1114,700,rnJO Stus) per
year. This matches closely the predicted usage o'F 114.0
MBtu per year of auxiliary energy, as predicted through
computer analysis.
A very small por'ticn of the energy required to heat the
building is supplied by the sun, due to the shading by the
Tippler, coniferous trees, and the 5~ overhang.
The addition of a 60~ by 8~ high sunspace along the
south side of ThE? lower floor will virtually cut the
auxilliary enerqy consumption in half. From 114.0 MBtu/year
to 54.2 MBtu/year. This equates to a savings of 1393
CCF o.f natural gas, or $557 per year. See tables 4 & 5 and
charts A and B for energy analysis breakdown.

DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATIONS
The owners of the three ground floor units of the Tipple Inn
request a variance to construct a solar addition to the south side
of their units. This will extend 10 ft. from the building for the
58 foot length of the building or 580 square feet, of which the
first 5 feet or 290 sq. ft. are an existing walkway under the
overhanging balconies and roof, and will extend only 2 feet beyond
the existing railroad tie planter box.
The purpose for the request is two-fold: to significantly
reduce noise and to conserve energy through appreciable solar gain.
An unnecessary hardship and practical difficulty to the
residents of the units exists due to the relocation of the main
entrance of the Tippler bar and disco from the slope (opposite
or east) side to the southwest corner adjacent to our residences.
It is virtually impossible for the occupants to sleep before 2:30am due
to the boisterous noisy drinkers arriving and departing the disco
through the night. We experience shouting, singing, profuse pro-
fanity, bottles and glasses being tossed on our premises and even
inebriated men urinating against our bedroom walls. Letters are
enclosed from Thomas S. Dunlop, Director of Aspen-Pitkin Environ-
mental Health Department and Lee L. Miller, Manager of the Tipple
Inn Condominiums, as confirmation of the severity of the noise
hardship that has been created.
The proposed construction will reduce noise impact by one-half
and in addition will reduce energy use by 50%1

This request is the minimum variance which will effectively
accomplish the combination of noise abatement and solar energy
conservation and thus make possible the reasonable use of the land
and building.
The four valid reasons for granting this variance exist:
That the special conditions and circumstances
do not result from the actions of the applicant.
The conditions result from the Tippler bar
relocating its main entrance (previously on the
opposite side of the building).
That special or extraordinary circumstances
apply to the subject property that do not apply
similarly to other properties in the same vicinity
and zone: and that the granting of a variance is
essential to the enjoyment of a substantial property
right enjoyed by other properties in the same vicinity
and zone, but denied the sUbject property because of
the special conditions or extraordinary circumstances.
The Tipple Inn residents are the only residents in
the same vicinity being denied the right to sleep
due to living immediately adjacent to the relocated
Tippler bar main entrnace.
