according to zoning officer, if the Dry.ly means. of access to bedrooms was through

Dear Frank:
This, letter is in response to your request of July 17, 1986 to
interpret the intent of the definition of duplex in Section 24-
3.1 (f) (2) of the l'lunici pal Code. The concept of requiring a
comon wall between the t\W dwelling units of a duplex is to
achieve greater conpaction of bulk and a reduction in cluttering
of structures within predominantly single-family and duplex
neighborhoods. The result of this requirement, to my understanding,
should be a reduction in the perceived bulk of the structure and
intensity of use of the site. Any specific interpretation of the
Code requirement is under the authority of the Zoning Official.

proposed Peters duplex on West North street. I have reviewed the
architectural drawings of the building and I realize that there
is some question as to whether the individual duplex units meet
the miniumum threshhold for being joined as duplex is defined by
the Aspen Municipal Code section 24-3.1 (f)(2), specifically, "A
detached principal building containing only two dwelling units
sharing a common wall no less than twenty(20) per cent between
both dwelling units or sharing a common ceiling and floor, in
whole or in part, connecting two(2) dwelling units."
I feel, however, that the design as proposed represents a less
intense use of the site than the full two family use allowed, and
furthermore that the attempt to break up the mass of the building
into the main house and carriage house units yields a structur'e
less bulky and more appropriate to the the Victorian character of
the general neighborhood than a more monolithic building.
I support the granting of a variance to the above mentioned
code section which would allow the construction of this building
as it is drawn.

This letter is in response to your request of July 17, 1986 to
interpret the intent of the definition of duplex in Section 24-
3.1 (f) (2) of the Municipal Code. The concept of requiring a
corranon wall between the two dwelling units of a duplex is to
achieve greater compaction of bulk and a reduction in cluttering
of structures within predominantly single-family and duplex
neighborhoods. The result of this requirement, to my understanding,
should be a reduction in the perceived bulk of the structure and
intensity of use of the site. Any specific interpretation of the
Code requirement is under the authority of the Zoning Official.
