BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, COlorado,
(or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious consideration to
the opinions of surrounding property owners and others affected in deciding
whether to grant or deny the request for variance.

Lot 5. Tipple Woods Subdivision
Dear Chairman and Board Members:
The applicant requests a variance from the rear-yard setback
requirement of 10 feet. instead requesting a rear-yard
setback of 5 feet. This will allow the owner to enclose an
existing deck which now encroaches 5 ft. into the setback.
as part of the master bedroom on the middle level. The roof
of this enclosure will then become an integral part of the
upper level deck.
The reason for this variance request is simply that the
house violates this setback for reasons outside the control
of the owner and his agents. When the original plans were
submitted for 8040 Greenline Review in 1979. the Planning
and Zoning Board required that the house be placed farther
uphill from its designed location. The reason cited was to
allow the continued use by neighbors of a "ski path" through
the trees. which connected condominiums to the southwest of
the property with Little Nell. At the time. this path was
narrow and informal. with no legal easement across the
subject property. Since then. the path has become wider.
now occupying between 10 and 15 feet across this lot.
because the use simply filled the space left undeveloped by
the requirement of the 8040 Greenline Review.
In brief. the reasons this application satisfies the
conditions set forth in Section 2-22(d) of the City Code are
as follows:
(1) "That the special conditions and circumstances do not
result from the actions of the applicant":
As stated above. existing encroachment results from
8040 Greenline Review. 7 Aug 79.
(2) "That special or extraordinary circumstances apply to
the subject property that do not apply similarly to other
properties in the same vicinity and zone":
The development of this owner's property is directly
affected by the use of his property by neighbors for ski-out
access. The only other property so affected is Mr.
Hemmeter's. located to the immediate south of the subject
lot. Being a much larger lot. however. the location of Mr.
Hemmeter's house was not affected by the neighbors' use of

his land for ski access.
(3) "That the granting of a variance is essential to the
enjoyment of a substantial property right enjoyed by other
properties in the same vicinity and lone. but denied the
subject property because of the special conditions or
extraordinary circumstances":
As originally designed, the house was within its
allowable F.A.R. by 600 sf. and was within its setbacks with
the south side being the required 25' front. and the north
being the required 10' rear yard setback. As revised to
meet the 8040 Greenline condition. the front and rear
setbacks were reversed (since the subject property borders
no public way) and the house location was rotated
counterclockwise to allow for the "ski path" on the north
side. The proposed development is still less than the
allowable F.A.R. by 200 sf. but this inherent property
right. to develop a certain allowable area of building. is
now impossible without encroachments into setbacks.
(4) "That the granting of the variance will not adversely
affect the general purpose of the comprehensive general
plan":
This master bedroom addition. which encroaches no more
than the existing deck. and is essentially underground. will
not adversely affect the health. safety. viewplanes, water
quality. air quality. control of rubbish. weeds and brush.
or degrade the general public good in any way. We believe.
instead. that a substantial improvement to the landscape and
public good will result from this work. We have spoken to
and visited the site with several of the adjacent
landowners. and have found no objections whatsoever to the
remodeling work intended.

our application for this variance.
