TO ALL PROPERTY OlVNERS AFFECTED BY THE REQUESTED ZONING OR USE-
VARIANCE DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as
amended, a public hearing will be held in the Council Room, City
Hall, Aspen, Colorado, (or at such other place as the meeting may
be then adjourned) to consider an application filed with the said
Board of Adjustment requesting authority for variance from the
provisions of the Zoning Ordinance, Chapter 24, Official Code of
Aspen. All persons affected by the proposed variance are invited
to appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to
such variance, as the Board of Adjustment will give serious
consideration to the opinions of surrounding property owners and
others affected in deciding whether to grant or deny the request
for variance.

MARQUSEE
VARIANCE REQUEST AND JUSTIFICATIONS FOR VARIANCE
Variance Request. Charlie and Helga Marqusee are the owners of
fractional Lots A thru I, Block 7, City and Townsite of Aspen,
Colorado (the "Property"). The Property is apparently zoned R-
15.
Pursuant to Subsection (a) of Section 24-13.6, Nonconforming
lots of record, a single-family dwelling may be constructed on
"any single lot of record" provided the lot (here all nine frac-
tional lots are involved) fails to meet the requirements for area
or width. Under Subsection (a) (2) of this Section, "yard dimen-
sions and requirements other than those applying to area. . .of
the lot shall conform to the regulations for the district in
which the lot is located. Variances of yard requirements shall
be obtained only through action of the board of adj ustment." The>
area of the "lot" is only 7,205 square feet where 15,000 square . ~
feet are required by the zone district.

A variance is requested to permit the dwelling to encroach
ldrfeet into the 25 foot front yard setback along thegillnopened
portion of Eighth Street and 10 feet into the 16 foot side yard
set back along the unopened portion of North Avenue. If the
variance is granted, Mr. and Mrs. Marqusee will construct a
single family dwelling of 2,018 square feet.
Justification for Variance. The size and shape of the lots
comprising the Property present the following special conditions
and circumstances: Applying the required setbacks of the R-15
zone district to the Property, the building "envelope" measures
23 feet in width on the westerly line and tapers to a point on
the ~ast. Only an oddly shaped house can be constructed on the
Property, one which would be unnecessarily long (60 to 70 feet)
or high (two stories the entire length of the structure) in order
to build a 2,000 square foot house. Neither configuration would
be compatible with the neighborhood.

We appreciate your notification of Charlie and Helga
Marqusee) s request for a variance on their properly
directly across the street from our home.
This properly is more than two hundred feet from our
house and the setback is over 100' from Meadows Road
with a row of intervening cottonwood trees. We have no
reason to feel that the variance will effect us adversely.
The row of cottonwood trees aJ.ong Meadows Road acts as
a screen. Charlie and Helga Marqueee have assured us that
those trees will remain and we are satisfied to accept
their assurance.
We, therefore, offer no objection and you may take this
letter as our supporl of Charlie and Helga's request for
