BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:

Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colorado,
(or at Isuch other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious consideration to
the opinions of surrounding property owners and others affected in deciding
whether to grant or deny the request for variance.

only powder rooms. #1) Property is located in the R-15 zoning
category. Section 24-3.4 Area and Bulk. Maximum height is 25 feet. Applicant
appears: to be requesting additional height variance. 12) Section 24-3.1 (g)
Dwelling unit definition. Applicant appears to be requesting the over
ruling lof the building department that his plan configuration of the
building results in additional units.

DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATIONS
1) Additional heip:ht for roofline above what the buildinp denartment

but no shoHer or bathtubs). Under this strict of an internertation
of the code, on~ of the two bathroom nlus houses or conooJ11iniuJ11s in
to,m would not be allowable.by the code. I feel this is an error.

The undersigne"l Adolph Barrailler, first sworn and uoon oath,
states as follows:
1) That he is over 21 years ~f age;
2) That he is a resident of the State of Colorado; and
3) That as the former O1vner of Lots 1 and 2, Shoaf' 5
\~aterfall Subdivision, County of Pitkin, State of Colorado,
that ourin? 1960/1961 he was in charge Of and ordered the
excavation on what is now Lot #2, Shoaf's Wat~fall Subdivision
for the presently existing house which has an approximately
900 square foot footprint.
Prior to said excavation the nresently existing grade
to the east of the structure extending to Neal Street of
aPDroximately 7924 feet above sealevel did in fact extend from
Neal Street to the east to tne sharo drop off of the Roaring Fork
River bank to the west. \,Jith the excavation for the basement at
that time in 1960jlQ6l ~or the existing house, tbe frade was
lowered aDnroximately 705 feet to the level of 79l6.S feet above
sealevel, as Der AlDine Surveys (see attached improvement
survey with the above referenced elevations) to the west.
Had the original grade been maintained and restored
after the original lQ6l construction the entire yard area would
be at the same grade as Neal Street, again anproximately 7924
feet above se~ level.
