BEFORE THE CITY OF ASPEN BOARD OF ADJUSTllEN'l'
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELGl:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colorado,
(or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for var iance f rom the prov i sions of the Zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious consideration to
the opinions of surrounding property owners and others affected in deciding
whether to grant or deny the request for variance.

Variance Requested: Requesting a variance to permit encroachment, of a
garage into a 10 foot front set back. The garage will be constructed under
the existing residence and will provide 2 full size off street parking
spaces. Currently no full size off street parking spaces can be provided.-
Property is located in the R-6 zoning category. Front yard set back is 10
feet, Section 24-3.4 area and bulk requirements. Applicant wants to build a
garage which would appear to encroach in to front yard set back 1 1/2 feet
at the south east corner and 6 feet at the north east corner requireing a
variance.

Dear Board Member;
The noor of the existing house al290 Park Avenue is approximalely 13 feet above Park Avenue.
Tha enUra west (fronll yard is a series of railroad lie walls which keep the house in place. Due
to this difficult topography and the narrowness of Park Avenue, there is currenUy no room for
the 2 minimum 6'-6" X 16'-0" off~treet parking spaces, Winters mean a conslanl battle
belween the city's snowplows and the applicants parked vehicles,
To create legal sized off-street parking for four vehicles, the applicant wishes to construct a
21'-0" X 26'-6" wide (600 SF) garage under the exisling one slory residence. To avoid the
danger and expense of undermining the eest (back) foundaUon wall, the garage will stop 4' short
of the exisling block foundaUon, A new concrete wall will be built to relain the solis under the
block foundation wall. Due to the shallowness of the lot at this point, (51,S') the new garage will
project into the front yard setback a minimum of 1'-6" at the southwest corner and a maximum
of six feet at the northwest corner. The building wall will still be 20'-6" from the road,
CurrenUy the off~treet spaces are 16'-6" deep, as a result of the new construcUon there wlll
be two spaces within the setback increased by 4' to 20'-6" deep, In addition two more spaces will
be within the garage.
Atlached Is a site plan Indicating the area of the proposed garage and the proposed encroschment.
