RE: 85-16 INDEPENDENCE LODGE
Dear Reno:
Please be advised that I am in strong opposition to the variance
requested by applicants/owners of the Independence Lodge. If the
variance is granted, the proposed roof deck would come into the
Wheeler view plane. All of the view planes in Aspen were estab-
lished for a very good reason and should not be challenged by
non-resident developers.
I trust the Board of Adjustment will remain sensitive to the
feelings of most Aspen citizens and reject this variance
proposal.

Re: Case # 85 - 11 (see other side)
Dear chairman, members of the board,
I am the owner of the Cooper street Pier Bldg., at
508 E.Cooper, across the street from the Independence Bldg.
and object to the requested variance. I had an access stairway
above my roof and the Aspen Bldg. Department requested me to
voluntarely remove it, as it could be seen from a distance.
I removed it, even so it did not protrude into the height
limitation. We still have access to the roof which one needs
fc~ service reasons. I am sure the Independence Bldg. can do
with the same, unless they want to use the roof commercially.
I am convinced this is their intent, because the request is
also for a roof deck. I do not believe it is a fair request
as I don't think they have ShO,ffi any necessity or undue
hardship to make an exception to the existing height limitations.
Instead I believe, that their proposal is exploitive, and should
be rejected.

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELCM:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colorado,
(or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious consideration to
the opinions of surrounding property owners and others affected in deciding
whether to grant or deny the request for variance.

Variance Requested: Request a height limit variance to allow the construction
of a 9 foot by 19 foot roof access stairway and roof deck which would
exceed the 40 foot height limit by 6 1/2 feet. Proposed addition to the
Independence Building, exceeds the 40 foot height limit for that commercial
core zone (See Article VIII, Section 24-3.4 area and bulk requirements,
CC(7) Aspen Code). This building is also in the Wheeler view plane. Proper
application has been made to that commission. Application does not add
floor area.
