NOTICE OF PUBLIC HEARING
CASE '85-14
BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colorado,
(or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the Zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections.
If you cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment will give serious consideration to
the opinions of surrounding property owners and others affected in deciding
whether to grant or deny the request for variance.

Dear Boardmembers:
The"owners of the Wienerstube Restaurant request the approval of the following
items:

The construction of 114 additional square feet of ground floor area,
to provide an enclosed windbreak at the delivery area. The additional
enclosure would permit deliveries to occur during business hours with-
out disrupting activities or creating a constant direct heat loss
through the otherwise open kitchen door. The enclosed area would also
protect delivered goods from weather and theft until employees can
attend to them. The restaurant will be open from 7:00 a.m. to 10:00
p.m. and therefore will not have a convenient delivery time.
ITEM 2:
For the use of some of the second level for storage purposes. This
area was originally created when the building was remodelled for
Sumo's Restaurant, and was essentially attic space above the furred-
down ceiling. The present remodel work created a large atrium area
through to the roof, which substantially reduced the area of the
attic. A new employee changing area and toilet room has been added
above the existing toilet room area and was permitted under a limited
allowed expansion of the building's F.A.R.. The remaining second
floor area consists of approximately 412.5 square feet.
Successfully competing under the GMP review process, the total allowed F.A.R.
for this building would be 12,000 square feet. A special review procedure
could permit a total of 18,000 square feet. The present building consists of
approximately 5,676 square feet. This application requests your approval for
an increase of approximately 526.5 square feet. None of the requested square
foot increase is for commerical floor area.

ITEM 3: For a variance which would permit them to have a circular stairway
to their second level. The stairway is for employee use only and
thereby constitutes a "private stairway". We had studied many
alternative arrangements for access to the second level, but the
present stairway design was the only one which the owners felt would
work for them. The need for a variance stems from a technical read-
ing of the Uniform Building Code which does not permit a winding
stairway in a commercial building. We have altered the stairway to
meet the code's definition of a circular stairway. A circular stair-
way is permitted when it is "private stairway serving an occupant
load of less then ten." We feel our stairway meets this description
and hereby request a variance which would deem our stairway to be
acceptable as defined. This would enable the 8uilding Department
to grant us a final certificate of occupancy.
