BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

The purpose of the Board of Adjustment is set out in Section.
2-21 of the Aspen Municipal Code. A full copy, of the Municipal
Code provisfons relevant to the Board are attached her~to, but, in
brief, the purpose is:
"The board of adjustment shall have the following powers and

duties, all of which shall be exercised

in harmony with
the purpose and intent of this chapter, and in accordance
with the public interest and the most appropriate development
of the area:
. (1) To hear and decide appeals from and review any order,
requirement, decision; or determination made by any

administrative official charged with the enforcement of
the regulations established by the zoning laws.

request for a building permit on property located within the City
or made any other decision unfavorable to you, on the basis of the

To make it clear' when the 60-day period starts" it is recom-
mended that you get such denial or decision of the building offi-
cial in writing with a specific date.
Within 60 days from the date of such denial or decision, you
must have your appeal application filed in the proper place and in
complete and proper form.

This pamphlet is to provide information on the standard pro-
cedure for filing and conducting your appeal.
Be advised, however, that there are many technical considera-
tions in a Board of Adjustment appeal and you may wish to consult
a lawyer, architect or other technical representative for advice
or assistance.
STANDARD PROCEDURE
~
1. First, obtain Board of Adjustment appeal forms from the
Building Department (located in the Upper Elementary School build-
ing at 110 East Hallam Street).
2. Complete the appeal form fully and accurately. Return
the completed appeal form to the Building Departmen~ along with:

3. As part of the appeal process, the applicant's/appel-
lant'~ neighbors are notified of the appeal requested and the
appeal hearing date so that they may be present at the appeal
hearing to listen, question, comment or object. The applicant is
responsible for providing the names and mailing addresses of all
of the neighbors and must pay a fee to help pay the 'costs of noti-
fying the neighbors.

If a USE variance is requested, notification must
be made to the owners of property within three
hundred (300') feet of the applicant's property
(read Section 2-22(c)(1)). The fee amount ($20.00)
is mad-e payaol-et~ the City of Aspen.
b. For varianc~s NOT RELATING TO THE USE, notification
must be made to the owners of property ad;acent to
the applicant's property (read Section 2-22(c)(2)).
The. fee amount ($10.00) is made payable to the City
of Aspen. For the purpose of. determining who is
adjacent, assume that the property lines of you and
your neighbors extend to the middle of streets,

alleys and intersections surrounding your property.

c. The applica~t must provide the Building Department
with th~ na~es and adjre~3?S of ~tl of the curr~~t
property owners required by the applicable variance
request, either those within 300 feet or those
adjacent. (The Co~nty Assessor, located in the
County Courthouse, is one source of names and
addresses of property owners. Title insurance com-
panies also provide this information for a fee.)
4. The appeal application is complete when the application
is properly filled out and filed with the Building Department
along with the related information, proper fee, and the complete
list .of required neighboring owners, those within 300 feet or
those adjacent, depending on which variance is sought. REMEMBER,
this all must be done within 60 days from the denial or decision.
5. The Building Department will review the appeal applica-
tion file and, if it is complete and on time, will forward it to
the City Clerk's office (second floor rear, Aspen City Hall, 130
South Galena Street, ASpen).

6. The Clerk will then assign the appeal a case number and
set the date of the appeal hearing.
7. When the date is set, the applicant must post a sign on
the property giving additional notice of the appeal to neighbors.
This sign must be in a certain form and posted for a certain time
and in a certain way and in a certain place (Section 2-22(c)(3)
a~d the attached memorandum). The Building Department will pro-
vide the applicant with one (1) blank sign ~orm at no additional
cost, or the applicant may provide his or her own sign, as long as
it meets the requirements of Section 2-22(c)(3).

8. At the hearing, the applicant must first prove th~t the

confirm if this ~as done) and posting of the sign. The ap?licant
should show the sign itself, a photograph of the posted sign and
an affidavit of the time and manner of posting '(a copy of a stan-
dard affidavit is attached hereto).
9.' Next, at the hearing, the applicant will present his or
her case. The applicant may present the case in person or through
a lawyer, architect or other representative.
10. ,The Board bases its decisions on the standards found in
Section 2-21 and 2-22(d)(1), (2), (3) and (4).
11. At the hearing, the applicant has a double burden of
proof, as follows: (1) the burden of going forward with his or
her case; and (2) the burden of proof. It is the applicant's
rasponsibility to come forward to make a case and to us'e that case
to convince the Board. The Board, while it may ask questions of
the applicant, has no responsibility for seeing that all of the

relevant facts come out and the proper arguments are made. The

The Board rarely find,s practical difficulties or
unnecessary hardship where the applicant's appeal
is a matter of aesthetics or design or ~conomics or

if a reasonable legal alternative is available. If
this first finding is not made, the appeal is
rejected.

Next, even if the Board finds practical difficul-
ties or unnecessary hardships, it must decide
wpether to grant the variance on the basis of the
factors found in 2-22(d)(1), (2)",l3) and (4). The
standards found in those four subsections are all
considered by the Board and the applicant's case
ought to deal with al~ of them, as they apply to
the applicant's situation.

13. The applicant may wish to research the minutes of pre-
vious Board of Adjustment appeal hearings, which are on file in
the City Clerk's office, to see which fact situations and argu-
ments were accepted by tile Bo<;rcl as valid and which ~lere not.
14. At the hearing, the applicant may wish to show eXhibits,
to have witnesses testify, to make an argument or even to ask the
Board to view the property. All exhibits presented at the hearing
must, be left with the Board as part of the permanent record of the
case.
15. If the appeal is denied, the app~icant may have a fur-
ther appeal to the Courts.

16. If the ar~eal is granted, the variance permit may in-
clud~ special terms or condi~iu~s that, in thE jDdgment of the
Bo<,rd, are necessary to balance the variance with other COITIf,luni.ty
interests. The Board is required by law to grant the minimum
variance necessary to make possible the reasonable use of the
applicant's property (Section 2-22(c)(7) and (c)(8)).
17. Variances are only valid for one year from the date the
variance is granted, unless otherwise stated by the Board. Build-
ing permits based on variances must be issued during the time the
variance is valid.

of the Board of Adjustment. The form and~-content required in such
posting is clearly delineated in the Oc-dinance.
If any such notice is given to any federal, state, county or muni-
cipal government or school or service district or other govern-
mental or quasi-governmental agncy, or to residential mUlti-family
condorr.inium unit owners through their homeowner I s association, it
shall be sent by first class mail or delivered personally at least
fifteen (15) days prior to the hearing date.
Applicants should be made aware of the fact that the posting
requirement is their responsibility and they must provide suffi-
cient evidence to the Board of Adjustment that they have in fact
complied with the terms of the Ordinance. I recommend that the
applicant be prepared to place the following into evidence at the
hearing:
a. The actual sign posted upon the property;
b. A photograph of the property showing the sign posted
thereon in a conspicuous place;
c. An affidavit of any person ever the age of 18 stating
that the person did post the sign and that he checked at
various intervals to prove that posting continued
through the entire ten day period.
What is considered a conspicuous place for the purpose of the
Ordinance is determined by the Board of Adjustment; however, since
every lot within the City abuts on a' public street or highway I
recommend that posting be done in such a manner as to allow the
sign to be readable from such a street or. highway,
A sign may be obtained from the Building Department. As well as
an affidavit to be completed by applicant and notarized.
