BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
T~ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance fLom the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Dear Members:
This letter is a request for a zero lot line variance for the
front yard of Lot 2, Hill House Condominiums located on Gibson
Avenue in Aspen.
A variance is requested for the following reasons:
1. As the attached plat illustrates, the lot is very
irregular in shape and this is a hardship to the applicant.
2. A ridge which runs east and west along the southern
portion of the building envelope causes a topographic hardship
to the applicant.
3. The property owners adjacent to the building site
have reviewed this application and support it as evidenced in
the enclosed letters.
4. In 1978 the previous owners of the parcel in question
were forced to give the city a 30-foot dedication along Gibson
Avenue. Neither the Hill House nor 707 Gibson, the adjoining
properties, comply with the 25-foot setback (R-30) from the
30-foot dedication line. The Engineering Department has indi-
cated that since neither adjoining property complies there is no
reason from an engineering standpoint for this applicant to com-
ply. In short, the applicant is asking for nothing that the
adjoining properties don't already have.
5. Even with the granting of this variance the resulting
structure will be 5 feet further from Gibson Avenue than before
the dedication was granted.
In summary:
a. the special conditions do not result from the
actions of the applicant;
b. special conditions apply to the applicant's
property that do not apply similarly to the
other property in the vicinity and zone;
c. granting of the variance is essential to the
enjoyment of a substantial property right;

d. granting of the variance will not affect the
comprehensive general plan.

City of Aspen. My unit is immediately to the west
of the parcel on which Lee Pardee is seeking a set-
back variance. I have read Mr. pardee's application,
and I wholeheartedly support it, as the granting of
the variance will have no effect on my property or
property rights.
