HomeMy WebLinkAboutlanduse case.boa.701 Gibson.017-84 NOTICE OF PUBLIC HEARING CASE NO. 84-17 BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the Council Room, City Hall, Aspen, Colorado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 24, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, then you are urged to state your views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. This appli- cation seeks permission to build a standard tennis court fence around the tennis court. The factors justifying this application are as follows: 1) There is a practical difficulty in that the Aspen Muni- cipal Code does nto allow chain link fences. Clearly the intent is to prevent a landowner from fencing in his property, not to prevent him from building a tennis court. The Code is silent about tennis court fences and this creates a hardship on the applicant. 2) At least 4 of the 5 neighbors who are adjacent to and can view the tennis court area have written letters in support of the tennis court. They feel that a tennis court will be a positive addition to, and will improve the neighborhood. 3) The proposed tennis court and fence comply with and are within all setbacks of the R-30 zone. 'This will not adversely affect the general purpose of the comprehensive general plan: ., 4) Thf granting of this variance is essential to the en- joyment of a substantial property right enjoyed by other properties; certainly there are other t~nnis courts in the City of Aspen. '.. . 5) The City council, the Planning and Zoning Commission, and the Board of Adjustment are all aware of my plans to build this tennis court and have approved applications which took into account the plac~ng of the court in this location.
