DESC:ZIBED BELOH:
Pursuant to the Off icial Code of .l\.Sr>8n of June 25, 1962, as amended, a
public hearing will be held in the Council Room, Ci ty Hall, Aspen, Colorado,
(or at such other place as the meeting may be then adjourned) to consider
an application filed with the said Board of Adjustment requesting authority
for variance from the provisions of the zoning Ordinance, Chapter 24,
Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections.
If you cannot appeo.r personally at such meeting, then you are urged to
state your views by letter, particularly if you have objection to such
variance, as the Board of Adjustment vlill give serious consideration to
the opinions of surrounding property ol'mers and others affected in deciding
whether to grant or deny the request for variance.

DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATION
The second floor offices in the Durant Mall have been overheating. The
reasons for this are: southern exposure and the increase in office personnel
and equipment.
The proposed exception is the construction of a platform to house the
mechanical equipment necessary to cool the office space. This platform is
9'x4\' and located on the southwest corner of the building. Although the area
is considered open space, it is not usable since it must remain clear to not
impead the entryway and the platform will provide shelter for this entryway.
A hardship has been created due to the fact that in order to occupy the
space as intended, a ventilation system is required. There is no other space
where this unit can be located without a variance. The building was originally
built to conform to allowable FAR requirements, but due to changes in the allowable
FAR and methods of computing the FAR, the building is now nonconforming under
existing FAR requirements. In order to install this system, it must have access to
outside fresh air and a way to drain excess water. If the system was moved inside
the space it is going to cool, there would be no way to install a drain for it,
and a fire wall would have to be penetrated to obtain enough fresh air to operate.
In order to relocate the unit to the roof, the duct vlOrk necessary vlOuld project
over the property line and it would have to tr2vel so far, by the time the cooled
air got into the building it would not be cool anymore.
We respectfully request a variance to install the cooling equipment as
shown on the enclosed drawings.
