Duesterberg: I have received your letter of Harch 5, 1984, along with prints of a proposed enclosure of a ground floor patio at Aspen Alps, Unit #203. The enclosed area will be an increase of 160 square feet. Although the interior remodel would be permitted by zoning, I must reject an. application for the addition. The Aspen Alps are located in the L-l zoning category. "Lodge units; boarding houses; hotel; dining room; laundry and recreational facilities for guests only," are the permitted use. The Aspen Alps Condominiums are a non-conforming use in this zone. Section 24-l3.4(a), "No existing structure devoted to a use not permitted by this code in the district in which it is located shall be enlarged, extended, constructed, reconstructed, moved or structurally altered except in changing the use of the structure to a use permitted in the district in which it is located;" (Aspen Municipal Code) You may appeal to the City of Aspen Board of Adjustment for relief of this decision or request a variance for the addition.
