BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance f~om the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yoU'views by letter, particularly if you have obj ec tion to such variance,'
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Re: Remodel at #203 Aspen Alps
Dear Hr. Duesterberg:
I have received your letter of Harch 5, 1984, along with prints of a
proposed enclosure of a ground floor patio at Aspen Alps, Unit #203.
The enclosed area will be an increase of 160 square feet. Although
the interior remodel would be permitted by zoning, I must reject an.
application for the addition.
The Aspen Alps are located in the L-l zoning category. "Lodge units;
boarding houses; hotel; dining room; laundry and recreational facilities
for guests only," are the permitted use. The Aspen Alps Condominiums
are a non-conforming use in this zone. Section 24-l3.4(a), "No existing
structure devoted to a use not permitted by this code in the district
in which it is located shall be enlarged, extended, constructed,
reconstructed, moved or structurally altered except in changing the
use of the structure to a use permitted in the district in which it
is located;" (Aspen Municipal Code)
You may appeal to the City of Aspen Board of Adjustment for relief of
this decision or request a variance for the addition. Please feel
free to contact me if you wish to apply to the Board of Adjustment or
if I can be of help in any other manner.
