BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENI
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance fcom the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

No existing structure devoted to a use not permitted by this code in the dis-
trict in which it is located shall be enlarged, extended, constructed, re-
constructed, moved or structurally altered except in changing the use of the
structure to a use permitted in the district in which it is located (Section
24-13.4 (a)). Applicant appears to be requesting to enlarge a non-conforming
use by 750 square feet.
The required setbacks are 10' in the front and 5' in the side. The applicant
also requests to build within the setbacks. This requires a variance of
4' front yard and l' sudeyard setback.

To the Board of Adjustment:
This letter is in application to the City Board of Adjustment for
a zoning variance on behalf of Scott and Patricia Edmondson. The
Edmondsons own Unit 2 of the 3 condominium units, all of which are
non-conforming structures on a total of three city lots. Present
zoning is R-6. The FAR of .45 would allow a build-out of 4047 SF
for a conforming duplex or single-family residence.
As a non-conforming structure. no increase in size or non-
conformity is allowed without a variance. The structure is
presently a 496 SF one-bedroom dwelling. The applicants request a
variance to increase the floor area to 1250 SF, resulting in a
total for the 3 units well below the floor area which would be
allowed for a conforming structure on this site, and setback
variances of approximately l' (side yard) and 4' (front yard) in
order to accomplish the improvements.
The Condominium Plat, as accepted by the City, shows that the
Edmondsons' unit includes an allocated storage loft. The appli-
cants plan to modify this area into a more normal second level,
used for a small study / living area and increased storage. This
accounts for most of the additional area in this application.
although it is already represented as floor area on the Plat.
Additionally, the applicants request a 12' extension of the living
area, which will include a passive solar south elevation. and a
small airlock / entry vestibule on the east side. All improve-
ments will be located within the applicants' Limited Common
Element. which allows this type of improvement.

Bill Drueding has determined that this condominium is a non-
conforming structure since there are three units, one more than is
allowed by Code, and the applicants agree with this decision. The
necessity of the application is therefore due to the non-
conforming conditions. There are also practical difficulties and
circumstances specific to this residence which are important in
the consideration of this application.
Granting of the variances will not result in significant impacts
to the neighborhood; the height, bulk and scale will be consistent
with adjacent structures. including the other two units of this
condominium, and the total floor area will remain well below
nearby residences as ~as the amount which is allowed in the R-
6 zone for conforming structures. No increase in occupancy or
change in use will result from these improvements. If the
variances are granted, the applicants will be able to improve the
appearance, thermal and energy efficiency, and overall quality of
the existing sub-standard structure. This will not only not
adversely affect the goals of Aspen's general plan. but wiTT
reinforce the quality of the neighborhood, as is demonstrated by
the support of the other two condominium owners.

Dear Mr. Drueding:
As the owners of Unit 3 of the West Francis Street Condominiums, we
support the Edmondsons' application for a variance to construct
additional floor area within the existing Limited Common Element of
Unit 2.
We understand that the application includes the addition of a second
floor on the existing structure, the extension of the living room
approximately 10 feet to the south, construction of a small entry
vestibule on the east, and construction of a grade-level deck.
We have been informed by the applicant that the granting of a
variance for Unit 2 does not in any way give the other owners of the
West Francis Street Condominiums the right to increase the
nonconformity of Units 1 and 3.
We support this application because the proposed improvements to Unit
2 will improve the appearance of our property without adversely
impacting the neighborhood in any way. T~e existing structure is
clearly sub-standard and there is no method by which it can be
upgraded satisfactorily without the granting of a variance. If
granted, the variances would allow the owners of Unit 2 to make their
unit consistent with the other units in terms of size and quality.
Please accept our comments in support of the proposed plans and as
acknowledgement of the limitation of any variances to Unit 2.

Dear Bill,
The office of the undersigned represents Dennis Ratner,
the owner of Unit 1, West Francis Condominiums. Mr. Ratner
has authorized me to support the Edmondsons' application for
a variance to construct additional floor area within the
existing Limited Common Elements of unit 2, as shown on the
recorded plat upon the conditions contained in this letter.
Mr. Ratner and I understand that the application includes
the addition of a second floor on the existing structure, the
extension of the living room approximately ten (10) feet to the

construction of a grade-level deck.
While I have been informed by the applicant that the
granting of a variance for Unit 2 does not in any way give
the other owners of the West Francis Street Condominiums the

approval is given only upon the condition that he and the
other owners of units in the West Francis Street Condominiums
are not precluded from making application for variances in the
future. Obviously Mr. Ratner cannot give his approval to a
