BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

Dear Remo and Board members,
ReI Hotel Lenado.
First, in case the qu~ion of conflict should be raised,
my wife and I sold the Forge property over two years ago,
and we have no financial interest in the property.
There exists on The Forge building a similar situation
to that at the Hotel Lenado, an exposed stairway leading
to a lower level. The architect and builder solved this
problem by installing snow melt stairs and landing, with
a dry well to take the run-off. There were no problems
with ice or snow last winter.
I submit that there are alternative solutions to this
problem, and that the Board should not grant variances to correct
problems which could have been solved by correct design
or engineering in advance.
Since I will be absent when this question comes before
the Board again, I request that this letter be read at the
hearing, and, if agreeable to the Board, made a part of the
record of the hearing,

Dear Bill:
Thanks for your time in discussion of our Board of Adjustment appeal
application filed "ith your office last week. I ,rrite no\< in response to
the question you raised at our meeting in regard to a potential.,problem
presented by our application in that roofing Hotel Lenado's service yard
might represent an unjustifiable FAR increase.
On several points, I believe some clarification of our case is in order; and
I ask you please to forHard the, enclosed copies of this letter to the Board
together "ith our application.
The rear yard setback requrement in the City's L-3 zone district (Sec.
24-3.4) is ten feet. No distinction is made between principal building and
accessory buildings. Perhaps then it should be understood that the setback
requirements for principal and accessory structures are one and the same;
however, this is open to question, as one note,s-,by "uy, of- cOl1trast: tbat the
Office zone district rear yard setback requirements, for example, are ,rritten:
"Principal, building - 15 Accessory building - 15."
The Hinicipal Cade requires that service yards be fenced so as not to be
visible from 'the street (Section 24-3.7 (h)(l)). Nothing is .rritten con-
cerning the roofing of such yards, but taking into consideration Aspen's
climate it would seem appropriate that such areas be covered. As a matter
-of fact and practicality, t\<o properties adjacent to Hotel Lenado, the Park
Central offices and the Hearthstone House, have covered service areas
including stairways within their rearyard setbacks, and sheds can be seen
abutting alleys throughout the \-lest End.
As to FAR, our architect, Harry Teague, anticipated the requirement that
the hotel's service stair, if covered, be counted as part of the hotel's
floor area; and he did count fortY''7t't.;o''~ square feet of the service area
in computing the project's FAR. The other part of the service yard he
considered being dedicated to th2 mechanical operation of the buildint, and
therefore no t to be counted in calculating FAR as provided for in the
Code (Sec. 24-3.7 (e) (4). This would seem entirely appropriate in th~t this

area is to he tnkcu up by transformer, electric meter, telephone pedestal,
etc. Of courst~, it Inay he arf,u('d th.'lt the HCTvice Y:1rd roof ShO\VIl on the
llotel Lenado plans covers a larger area than is absolutely nccc,ssary. The
fact is, howev"r, that the "idth of this space is dictated by the location
of an existing transformer ~ Harry Teague did inquire last Fall about the.
possibili.ty of moving that transformer; the city Electric Dept. informed
him th1.t, to move it even a fc\.,J feet \"Quld cost a thousand dollars or morc"
\vhich seemed to our partnership to be an unreasonable and unnecessary expense.
In closing, I believe it may be fitting that the Board of Adjustment knm,
that the issue of the service area "as brol.ght up by us at the Planning &
Zoning Corrmission hearing given the Hotel Lenado project last" Febr"uary,' There
was a brief discussion of the. matter, and no member of the Commission voiced
objection. Jay Hammond of the City Engineer's office was questioned in
regard to .accessibility of the transformer if the service area. "as roofed, and
he indicated he had no problem there. I understand the ,Board of Adjustment
must look to the let ter of the la,,; I hope the Board "ill agree that Hotel
Lenado's request for a variance is not inappropriate, our plans being quite
in keeping "ith the spirit of the City's zoning rc,gulations.
