TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOH:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state..

as the Board of Adjustment will give serious consideration to the opinions

DESCRIPTION OF PHOPOSED EXCEPTION SHO\VING JUSTIFICATIO,iS:
Applicant asks that the Board reconsider its decision of September
29th in the light of several previously unconsidered facts and now
grant a setback variance to permit building of a cano~y over Hotel
Lenado's basement level exitway, which canopy will project four feet
into the hotel's required front yard setback, as necessary to protect
the public from the real danger of falling ice, which danger cannot
be alleviated by alternative means - snow rings, heat tape, heated
sidewalk _ suggested by the Hoard at our hearin;; September 29th. We
believe such variance is justifiable as dan6er to the public consti-
tutes' a real hardship and as the planned canopy, designed to pro-
tect the public, represents a good and reasonable solution to this
problem, which solution will not adversely affect the general pur-
pose of the City's comprehensive general plan as set forth in cur-
rent zoning regulations, in consideration of the fact that the Code
explicitly permits fire escapes to project four feet into required
yards and even permits balconies to project up to four feet into
required yards. The variance we request is further justified by the
fact that a building permit was issued to the applicant for Hotel
Lenado's foundation work based upon architectural drawings which
clearly showed the planned canopy; only after the fact was any ques-
tion raised by the Building Department in regard to the permissibility
of said canopy. Plans showing the canopy were submitted to the Building
Department in late April, foundation work necessary to support of the
canopy \.as complete in mid-June, and it was not until July 13th that
we were first made aware the canopy might not ne permitted.
