NOTICE OF PUBLIC HEARING

BEFORE THE CITY. OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW: .
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24. Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state..
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance. .

Aspen Board of Zoning Adjustment
February 11, 1982
The Aspen Board of Zoning Adjustment held a regular meeting on February 11, 1982
at 4:00pm in the City Council Chambers. Memliers present were Remo Lavagnino,
John Herz, Josephine Mann, Charles Paterson and Francis \o.1hitaker.
Minutes - Francis Whitaker moves the minutes of December 17, 1981 be approved as
cqrrected. Josephine Mann seconds. Francis jihitaker nloves the minutes of December 10,
1981 be approved as corrected. Josephine Mann seconds.
All in favor. Motion carried.
Case #82-1 Ryan/McGuire
Remo Lavagnino stated that nowhere on the application is there is a reason for what the
Commission is granting a variance for, or even an indication of what they are asking for
in the variance. Remo said that in the past the Building Department would site the
Code violation and the request of the applicant as to what he wanted in terms of
that variance from that Code requirement.
Francis Whitaker said there is no stated distance for the variance.

Remo Lavagnino said that th e Board of Zoning Adjustment does not have enough informa-
tion on what is actually being requested.
. J~D. Mueller, is appearing for Gary Wright, Attorney, said that he would answer as many
questions as he can about this application. J.D. Mueller filed with the Clerk an af-
fadavit that the notice was posted and that the adjacent property o,;ners were notified.
The representative for the Case and the Board members review the blueprints.
J.D. Mueller requests that the case be tabled until the applicant provides the Board
with enough information to review.
Charles Paterson suggests that J.D. tell the applicant that
an elevation and a floor plan that is more substantial than
of paper.
Remo Lavagnino said that the applicants primary concern
is that he demonstrate that there is a unique situation
hardship or practical difficulty.

the applicant to the reasons why he can come before the Board of Zoning Adjustment
and so that he may present his case in a manner that speaks.directly to the Boards
reasons for granting a variance.
Paul Taddllne, City Attorney, said that his office is in the process of preparing a
brochure with explanation on the procedure of applying for a variance to the Board
of Zoning Adjustment.
Charles Paterson moves to adjourn the meeting.

Case #82-1, Ryan/McGuire
First, I apologize for not being able to attend your September 30,
1982, meeting. As you probably know, I will be attending the
Colorado Bar Association Convention in Colorado Springs on that
day.
Last week, I was contacted by a local lawyer, Bill Clark, concern-
ing the above-referenced case. Mr. Clark may appear at your Sep-
tember 30 meeting to ask that some action be taken on #82-1.
I have reviewed the minutes of #82-1, a copy of which are
attached. It appears that the application was duly filed and duly
noticed for the February 11, 1982, meeting. It appears that the
applicant was represented by counsel, who presented the case in
the form of an application, blueprints and argument. It is clear
that the Board found that the applicant had not shown sufficient
evidence of undue hardship or practical difficulty. At the
request of the applicant's attorney, the case was tabled to enable
the applicant to put on additional evidence, if any. No addi-
tional evidence was presented.
In my opinion, at this time, it is proper only to put the case on
the docket and vote to deny the application on the grounds that
applicant failed to show sufficient evidence of undue hardship or
practical difficulties. That action would close the file on Case
#82-1.
In my opinion, it would clearly be improper at this time to re-
open the case to permit additional evidence or argument to be
taken. Such an action would require a new set of public notices.
I am writing this as an accommodation to the applicant because I
will be absent from the September 30 meeting. Of course, you may
decide not to add this item to your agenda or to add it and table
it until your counsel is present.

However, my recommendation based on the fact before me, is that
you simply add the case to your docket and vote to deny the appli-
cation on the basis of the evidence presented at the duly-noticed
Board of Adjustment meeting of Feburary 11, 1982.
