Re: Edelweiss Lodge
Dear Board Members:
1. Introduction.
We represent the Edelweiss Partnership, the owner
of the Edelweiss Lodge, which by this application seeks to vary
the provisions of Section 24-3.2 of the Aspen City Code (dealing
with permitted and conditional uses) in order to improve the
lodge with a small family-type locally-oriented restaurant.
The Edelweiss Lodge is situate on the corner of
Hopkins and Aspen streets, Lots A, Band C, Block 75, City of
Aspen. The property is zoned O-Office. As you know, among
other things, restaurants are a conditional use in this zone,
but " * * * only for structures which have received historic
designation * * *." Since the Edelweiss Lodge has not received
historical designation and, we have been given to understand by
Colette Penne of the Planning Office who advises the HPC, the
Lodge will not qualify for that designation, it is this limitation
that the applicant seeks to have varied in this instance in
order that it might have a conditional use application for a
restaurant considered by the Planning and Zoning Commission.
2. Proposa 1 .
If the Board of Adjustment grants a variance from
the limitation requiring historical designation before conditional
uses in the O-Office zone may be applied for, the applicant
intends then to apply to the Planning and Zoning Commission for
conditional use approval in order to renovate approximately 1200
square feet of the lodge to provide for (a) a restaurant of
approximately 700 square feet; and (b) employee housing of
approximately 500 square feet to be used by employees of this
restaurant. The renovation will be consistent with applicable
area and bulk requirements, will not increase the number of
units or square feet presently associated with the lodge and
will be done at an investment of less than fifty percent of the
value of the structure to be renovated. See Section 24-13.10 of
the City Code. In the course of renovation, the structure will
be made significantly sounder from a health and safety standpoint

in that fire insulation and flooring, plumbing and electrical
systems will be substantially upgraded.
3. Reasons for Variance.
The Edelweiss Partnership consists of Elizabeth M.
Jones and Gebhard Long. It was recently formed when Mr. Long ac-
quired from Ms. Jones a one-half interest in the lodge in the hope
and expectation that Mr. Long, experienced in lodge management,
might restore a competitive edge to the lodge which had been lost
due to the inability from other demands upon her time of Ms. Jones
meaningfully to maintain the lodge as an income producing property.
Presently, the lodge is rather dilapidated and, due to size con-
straints, not capable of being competitive with other lodges or
being run at a scale to make it profitable. As you know, reno-
vation under Section 24-13.10 cannot result in an increase to the
square footage. The present square footage is, simply stated, im-
practical and mere renovation (with this constraint) would not make
the lodge any the more economically viable. The Planning Office has
discouraged the applicant from seeking a rezoning of the property to
a Lodge classification, which would allow for a restaurant, since it
is presently in the midst of master planning for lodges and has also
discouraged the applicant from abandoning the lodge use in favor of
an office building, given the increasing need for small-lodge tourist
accommodations. Installation of a restaurant has been considered by
the applicant and the Planning Office as an interim solution in order
that the property might be upgraded and generate income pending the
Planning Office's comprehensive planning for lodges.
Most importantly, we have been advised by the
Planning Office that the restriction of restaurants as a conditional
use in the O-Office zone to historically designated buildings was
intended to curb the proliferation of restaurants on Main Street
and was not intended to cover the Edelweiss Lodge situation. Where
in a particular situation the rationale for a limitation gives way
so too, we believe, should the limitation itself.
Accompanying this letter is a listing of property owners
within 300 feet of the Edelweiss Lodge.

We have been informed that the Edelweiss
Lodge is requesting a variance in zoning
to allow them to establish a restaurant on
the property.
We wish to

TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
