T:::. 501 664 3012 P.02 TO: BOARD OF ADJUST~1ENf FROM: ORIGINAL STREET CONDOMli'<lUM DATE: AUGUST 16, 1995 The owners of the building at 802 East Cooper Street, known as Original Street Condominium, arc requesting a variance from the Board so that we may construct a six foot, tongue-and-groove, redwood privacy fence on our property. The new fence will be in the same location as the existing fence and wi!! be no higher than -;ix feet, measured from street grade. Listed below for vour consideration are the reasons we feel this , variance is justified: 1. There is already an existing roW of spruce trees (having been grand fathered in) on the West side of the property, which provides a vision barrier much taller than a six foot fence. 2. A few years ago, the City ,"risely installed a four-way stop sign at the comer of Cooper and Original Streets to <:nSure the safety of pedestrian and vehicular traffic. The stopping point for vehicles on Cooper Street heading West is beyond dot: existing and proposed fence line. The proposed fence would in no way obstruct the vision of a driver heading South and turning East on to Cooper Street. 3. The Condominiums are located on one of the busiest comers in Aspen, making privacy virtually impossible with the existing fence. Vehicular (automobiles, buses, campers, trucks. motorcycles, etc.) and pedestrian traffic begins early in the morning and continues into the wee hours, particularly in surruner months when we like to leave windows and ~liding doors open for ventilation. Foot traffic comes within twenty feet and vehicular traffic within t.lUrty feet of the sliding glass doors of the ground level condominium, permitting unobstructed vision into the living and dining areas. 4. In addition to the invasion of privacy, exhaust fumes from buses and trucks are an ever increasing discomfort made more noticeable by the stopping <L.'1.d starti.ng motion required by the four-way stop. We feel a six foot fence would significantly reduce this annoyance. 5. We feel that the high quality, attractive fence we are proposing would greatly enhance the aesthetics of the property invulved and the surrounding area. The pictures t<Ll.;,m from outside the building, we feel, show very dearly that construction of a -,;ix foot fence would in no way impair the vision of a driver at the corner of Cooper and Original Streets. The other photographs taken from inside the ground level unit speak for themselves as to the proximity of vehicular and pedestrian traffic. In conjunction with the Board's on-sight inspection, we would respectfully request an observation be made from the front porch during a peak traffic time.
