Pursuant to the Official Code of Aspen of June 25, 1962, as amended,. a
public hearing will be held in the Council Room, City Hall,. Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state..

The applicant wishes a variance fromAsp~n City Code Artidle VIII Section
24-8.13 to allow him to subdivide his property into 2 tracts. At'present the
property ~asures 1l~ feet~lo~th~south prop~rty line, and 117.67 feet along
the north property l1ne.S1nceth1s property 1S located in an R-6 zone where
the minimum lot width permitted is 60~, a subdivision would create a lo~ which

The appl cant wishes a variance from Aspe~ City Code Article VI I I, Section 24-8.13 to
allow hi to subdivide his property into 2 tracts.. At present the property measures
119 feet along'the south property line, and 117.67 feet along the north property line.
Since th s property is located ia an R-6 zone, where the ~inimum lot width permitted is 60',
a subdiv sion would create a lot which would measure 59" along the south property line
and 57.6 I along the north property line. -In view of-some of the uncertainties of
s.urveyin in the 'Hallam's addition (see attac.hed letter from Alpine Surveys), applicant
feels a ~riance would allow him a reasonable use of his property without creating any
conflict with the surrounding property owners.

Dear Clayton:
As you know, C. F. Murphy has applied for a
frontage variance on his property in Hallam's Addition.
Surveying in Hallam's Addition has always been an
uncertain proposition, and while I am confident that
my survey of the Murphy property is accurate, I must
point out that monuments set by Gerard Pesman would
place the West line of the Murphy property some
three feet West of my survey.
Because of the inherent uncertainty in locating the
true position of property in this area, I believe it is
appropriate for the Building Department to support the
granting of a variance.

I disapprove of this variance request, as one of Mr.
Murphy's closest neighbours; he has already gotten a
variance for a tennis court, the noise from which is in-
tolerable during the summer months. He built a huge rail-
road-tie retaining wall in my view. Next he landscaped the
end of Gillespie St. which I had previously used as a
parking space, using it for his private "beautification"
project. Apparently the felt free to do this without con-
sulting me because it is city land. I do not know if he
thought fit to consult the city.
When I came to this corner of Aspen in 1948, as a
child, I learned to love the openness of the land and
the Victorian style of the houses. I am a permanent
resident of Aspen, as is everyone on my street with the
exception of Mr. Murphy and Mr. Hume. Mr. Hume cherishes
open vistas as much as I do. It is my humble contention
that if Mr. Murphy is permitted to subdivide his proper-
ty and build a s.ructure out of keeping with the Victo-
rian mode that the corner of Lake and Gillespie will
soon be ornamented with a costly architectural faux pas.
The position of the tennis court - built wTEila
variance - seems to me to make a subdivision impossible...?
