TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state".
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

1. That I am over the age of 18 years;
2. That on April 25, 1980, Mary Perkins did post a
Notice of Variance Hearing upon the dwelling located on
Lots A and B, Block 38, City of Aspen, Colorado;
3. That on each day from and after April 26, 1980
through May 8, 1980 I did ascertain, while driving past
the property, that the Notice of Variance Hearing posted
on April 25, 1980, continued to be posted and visible.

APPEAL TO BOARD OF ZONING ADJUSTMENT
CITY OF ASPEN
DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATIONS:
This is an appeal from a determination by the City Attorney,
Ron Stock, and Sunny Vann of the Planning Office to the effect
that Mary Perkins' residence is a non-conforming structure
under Aspen City Code Section 20-9(c) and the City Attorney's
interpretation thereof. A copy of the City Attorney's Memorandum
is attached. Mrs. Perkins requested a subdivision exemption to
permit her to divide her 9 lots (the Swiss Chalet Property) into
2 parcels, one consisting of 2 lots for her residence and the
second consisting of 7 lots. As a result of the above determina-
tion, her request for subdivision exemption was denied. The
non-conforming elements include:
1. Shortage in minimum width - Lots A & B, on
which the Perkins' residence is situated,
are 59.97 feet wide and not the required
60.00 feet in width; and
2. Shortage in the required 6,000 minimum lot
area per dwelling for Lots A & B (O-office
zone);
3. Encroachment by the Perkins residence into
the 10 foot front yard set-back.
The appellant requests a variance with respect to (1) the minimum
width of Lots A & B, (00.03'), (2) the shortage in lot area (5,997
square feet) and (3) encroachment into the front yard set-back.
If granted, the appellant will then be in a position to pursue
subdivision exemption.

As justi~ication the appellant submits the ~ollowing:
1. The shortage in minimum width ~or Lots A & B
results from a shortage in width for the entire
Block. A fair allocation of this shortage yields
a shortage for Lots A & B of 00.03 feet as well
as produces the shortage in the required 6,000
square foot minimum for 2 City lots. These
conditions do not result from the actions of the
applicant but rather an "error" when Block 38
was originally surveyed and platted as a Townsite
Block. Nor does this special circumstance apply
to many other (though to some) properties within
the Original Aspen Townsite. Because of this
circumstance, Mrs. Perkins should not be pre-
cluded from subdividing her property along the
original lot lines as others have been permitted
to do.
2. As to the variance for the front yard setback
violation, Mrs. Perkins was told by the City
Building Inspector in 1959 that the front of
her residence could be constructed so as to
be aligned with the front of the eastern most
Swiss Chalet cabin located on the front portion
of Lot I. In 1959 the Aspen Municipal Code did
not require a front yard setback. Thus, it was
through subsequent ordinances enacting a front
yard setback requirement that the structure
became non-conforming. Here, too, these circum-
stances were beyond the appellant's control.
Since the structure has existed 21 years, clearly
the variance requested will not adversely a~fect
the general purpose of the comprehensive plan.

Madame:
Accompanying this letter is an appeal to the Board of Adjust-
ment by Mary E. Perkins, appellant together with our check in the
amount of $10.00 to cover the required fee. This is an appeal
from a determination made by an administrative official charged
with the enforcement of the regulations established by the City
of Aspen zoning laws (Section 2-21(1)). Accompanying the Appeal
is a copy of a memorandum from City Attorney, Ron Stock, dated
March 10, 1980 together with two prints of an Improvement Survey
of Lots A through I, Block 38, City and Townsite of Aspen. I
would appreciate this Appeal being scheduled at the earliest
possible time following the giving of written notice to the adjoin-
ing property owners.
I further enclose with this letter a copy of the Adjacent
Owners Certificate which has been furnished by Aspen Title Company.
The Certificate lists the property description and names of all
owners of record of lots adjacent to Lots A through I, Block 38.
I have added the mailing addresses to the Certificate of all of
the owners listed thereon.

Gentlemen:
I recently received notice of a request for a variance for the property
that is presently owned by Mary Perkins and located directly across the
alley from my property. It is my understanding that this is not a request
for a zoning change, but simply a request for a variance of existing zoning
regulations which would allow Mary to have her house, which is on two city
lots, separated from the remaining seven lots. I also note that the two lots
are just slightly less than the required lot size.
I see no objection to this variance and feel that it is in the best in-
terest of the neighborhood for this variance to be accepted.
