P : ~ l.~_ . ~ II J ~ ~ II NOTICE OF PUBLIC HEARING Case No. 80-1 ~ BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE DESCRIBED BELOW: Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a public hearing will be held in the Council Room, City Hall, Aspen, Colo- rado, (or at such other place as the meeting may be then adjourned) to consider an application filed with the said Board of Adjustment requesting authority for variance from the provisions of the Zoning Ordinance, Chapter 24, Official Code of Aspen. All persons affected by the proposed variance are invited to appear and state their views, protests or objections. If you cannot appear personally at such meeting, then you are urged to state. yo~views by letter, particularly if you have objection to such variance, as the Board of Adjustment will give serious consideration to the opinions of surrounding property owners and others affected in deciding whether to grant or deny the request for variance. DESCRIPTION OF PROPOSED EXCEPTION SHOHING JUSTIFICATIOns: A submissjon is hereby requested for a 10 foot front yard setback variance. Incl~ded in this request please find a vicinity map. and a property survey of subject property. Presently the subject lies within the county R-15A zoning district and thereby must comply with, but not limited to, a 25 foot front yard and 5 foot side yard setback. In con- sideration of the 100 yard flood plane, prepared by the Army Corps of Engineers for the City of Aspen and within county (see attached property survey), I would be restricted to a 21 foot depth for a single family dwelling without a,front yard setback. There is presently a 15 foot roadway easement servicing one additional dwelling unit past subject property which should not generate significant traffic as this is not a public thoroughfare. I don't feel the aforementioned variance will have the same impilct as if it were located ,on a major public 'street. Further, in consideration of the variance, applicant will remove the existing shed which is in violation of the side yard setback requirement. At close inspection of property survey it is apparent that a hardship is created by the flood plane* Will you be represented by counsel?
