RE: Covering of Exterior stairs at Roaring Fork Building

Dear Board Members:
This exception is to allow the construction of a roof over the stairways
on the north end of the arcade between the Roaring Fork Building and the
Paragon Building, i.e. the stairways leading to the Souper and the offices
in that building leading from the }full. The arcade was originally pro-
vided as a mid-block pedestrian link (as was the Arcade which was required
by the Planning Office in the Mason & Morse Building) and open space.
It was one of the first buildings where these types of requirements were
imposed. Unfortunately, in the winters it serves neither as a pedestrian
link nor as open space. It is a dangerous, 10' wide x 3 storey high snow-
filled slot between the two buildings, the most treacherous part being
the stairs at the North End. If you will refer to the application for a
variance applied for by the Mason and Morse Building (then known as the
Hyman Avenue Building) there was a precedent set by your board for a re-
duction in "open space' in return for a covered "mid-block pedestrian
link" that was functional and practical.
In this case, it also improves public safety. This is also a special and
extraordinary circumstance that is unique to this property. The "sub-
stantial property right enjoyed by other properties" is the right to safe
access for customers and office workers. Even when show is shoveled daily,
ice forms on the stairs. The "extraordinary circumstances" resulted from
the implementation of new and as yet then untried ordinances and restric-
tions, that have since been revised.

BEFORE THE CITY OF ASPEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
