BEFORE THE CITY OF AS PEN BOARD OF ADJUSTMENT
TO ALL PROPERTY OWNERS AFFECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended,. a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to
grant or deny the request for variance.

DESCRIPTION OF PROPOSED EXCEPTION SHOWING JUSTIFICATIONS:
Application for Pl?rmit together.'with.plans were submitted 11-17-78
after detailed consultations with the Building Department by our-
selves and our architect, We were told on June 1, 1979 that our
plans were ok but the permit is being denied because of proposals
before .the city counsel pertaining to future Changes in the Build-
ing Code. We are not aSking for any exception under the present
code, but due to the length of time in consideration.our applica-
tion, we feel that this constitutes a refusal and that we are being
denied reasonable use of our property.

Dear Mr. Stark:
The plans for your proposed addition and remodel of your property
at 619 N. Fourth Street, Aspen, Colorado bav~ been reviewed by the
Aspen Building Department for compliance with the City's zoning
ordinance. Your proposal to change the existing accessory building
from a garage to a dwelling unit would not be permited since your
property is a non-conforming lot of record as explained in Section
24-12.6 of the Municipal Code of the City of Aspen. The existing
accessory building encroaches into the alley which would further
prohibit a change in use. You could, however, do ordinary repairs
and maintenance to this building to upgrade the property.
A dwelling unit is defined in the zoning ordinance as "One or more
rooms, in addition to a kitchen and/or bath facilities, intended
or designed for occupancy by a family or guests independent of
otber families or guests."

The plans as presented for the addition and remodel of the main
dwelling unit would also be denied by the above definition since
a conversion to a two-family could easily be done with very little
effort as I explained to you when you were in my office earlier
this weelc.
It would appear to me that you could solve your problem by amend-
ing your plans by leaving the garage as a garage but remodel so
it is more useful as a garage and help solve your parking problem.
The plans for the main dwelling would have to be changed so that
a conversion to a two-family could not be easily accomplished by
any future owners. I do not feel that a revision would be that
difficult to do.

Dear Mr. Ellis:
This will confirm our discussion of December 28, 1978 when I visited your
office.
In accordance with your request, I am enclosing the following:
1. A survey made October 11, 1978 of the north 44' of Lots 16, 17,
18, 19 and 20, Block 99, Hallams Addition.
2. Architectural drawing of proposed upgrading, repairs and improve-
ments to the existing structure located on the northeast corner
of the property.
You will note that the latest survey enclosed, shows that the structure which we
discussed encroaches onto the alley. You will also note that the wood fence
enclosing the property facing Gillespie Street also encroaches on the alley and
that a power line pole was placed in the middle of the alley.
We purchased the above.described property and existing buildings in September of
1972 and we were not made aware of any encroachments at that time.
In order to eliminate any future problems or encumbrances, we are requesting a
variance from the City in that we may be granted an easement to be shown in the
public records.
