DESCRIBED BELotJ:
Pursuant to t~e Official Code of Aspen of June 25, 1962, as amende5, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at ~uch other place as the meeting may be then adjourned) to
consider an atplication filed with the said Board of Adjustment requesting
authority for;variance from the provisions of the Zoning Ordinance, Chapter
24, Official f,ode of Aspen. All persons affected by the proposed v~riance
are invited t~ appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.

COMES NOW the Applicant, the Aspen Skiing Corporation,
and requests a variance from the Board of Adjustment of the City
of Aspen, Colorado, to permit it to construct a snowmaking
control building and that portion of its proposed Aspen Mountain
snowmaking facility situate within the City of Aspen which may
encroach within the Wheeler Opera House View Plane or any other
view plane established by ordinances of the City of Aspen. The
control building site is more fully shown on the Site Plan
attached hereto and made a part hereof by this reference.
Reference is also made to Applicant's Application before the
Planning and zoning Commission of the City of Aspen for 8040
Greenline Review and a Conditional Use Permit regarding the
same facilities, which was granted approval by that Board at
its regular meeting held on May 8, 1978.
The Applicant states as grounds for the granting of
the variance that there are practical difficulties and
unnecessary hardships in the way of carrying out the strict
letter of the zoning laws prohibiting encroachment into establish
ed view planes; that special or extraordinary circumstances apply
to the subject property that do not apply to other properties
in the same vicinity or zone; and that the granting of the
variance will not adversely affect the general purpose of the
comprehensive purpose of the general plan.

COMES NOW the Applicant, the Aspen Skiing Corporation,
and requests a review by the Planning and Zoning Commission of
the City of Aspen, Colorado, for approval of its proposed
control building for its Aspen Mountain snowmaking facility
and approval of those portions of its proposed snowmaking
facility lying or which may encroach within any view plane
established by the ordinances of the City of Aspen. Applicant
incorporates herein as if set forth fully its Application before
the Planning and Zoning Commission of the City of Aspen for 8040
Greenline Review and a Conditional Use Permit regarding the same
facilities, which said Application was granted approval by the
Board at its regular meeting held on Nay 8, 1978.
