Pursuant to the Official Cocle of Aspen of June 25, 1962, as anlended, a
public hearing will be held in the Council Room, City Hall, Aspen,Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official Code of Aspen. All persons affected by the proposed v~riance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.
yo~views by letter, parti~ularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property owners and others affected in deciding whether to

Re: Proposed Addition to Sabbatini Sport

Application for a variance to al low the construction of a
690 square foot addition to the subject property has been
filed with Clayton H. Meyring, Chief Building Inspector
of the City of Aspen.
The proposed addition would be a second story over the rear
portion of the building constructed in 1968. Such an
addition was anticipated in 1968. However, the zoning laws
have since changed making even the existing building non-
conforming to floor area ratio requirements.
The present floor area ration is 2.62:1 and on behalf of
the owner, Mr. Dexter Williams, I am requesting a variance
to allow an addition to a non-conforming building which wil I
increase this floor area ratio to 2.98:1. A recent survey
and square footage calculations have also been filed with
the Building Inspector showing how these figures were deter-
mined. No additional drawings are being submitted at this
time since the location and size of the addition are obvious
and limited to only one area.
In a recent meeting with Clayton Meyring, it was agreed that
no new addition would be built over the small encroachment
of the present building into the alley or adjacent property.
It was also determined that since no open space exists, a
variance for open space is not necessary since the addition
can not make a nonexistant open space more non-conforming.

Dexter Williams needsthe additional space to better serve
the Aspen Winter Visitor. Since the building is an old
Victorian originally built from property line to property
line and Sabbatini Sport being an established business with
no way to expand except by going up, the case is clearly
one of hardship.
We feel that the fol lowing are valid reasons for your
consideration in granting this Variance request:
(1) "That the granting of a variance is essential to the
enjoyment of a substantial property right enjoyed by
other properties and zone, but denied the subject
property because of the special conditions or extra-
ordinary circumstances." Needless to say, there are
numerous businesses and buildings that do enjoy a
greater floor area and floor area ratio which were
built within the conformance of the zoning ordinance
at the time but are now considered "non-conforming".
(2 ) "That the grant i ng of the va r i ance will not adverse I y
affect the general purpose of the comprehensive
general plan."
(3) The impact of the addition on the surrounding area
will be negligible.
Since the building is in the Historic District, it is
understood that any addition wit I need approval of the
Historic Preservation Committee. It is further understood
that we may be subjected to the Growth Management Ordinance
when adopted. However, it would be foolish to pursue these
other courses without first having a Variance from your
Boa rd.

building across the alley from the rear end of Sabbatin
Sports, has no objections to their plan to construct a
second story over the rental shop at the rear of their
existing structure.
Since the front end of the building already has a second

erty owner, I find this addition acceptable as I am

Mr. Dexter Williams has explained to me his desire to
construct an addition consisting of approximately 600 square
feet and has indicated that he has applied to the Board of
Adjustment for a variance from the floor area ratio requirement.
As an owner of real property in Block 88, I have no objection
to the granting of this variance. As a matter of fact, I would
encourage the Board to favorably consider Mr. William's appli-
cation.
