Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance f~om the provisions of the Zoning Ordinance, Chapter
24, Official.Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state..
yorrviews by letter, particularly if you have objection to such variance,
as the Board of Adjustment will give serious consideration to the opinions
of surrounding property ovmers and others affected in deciding whether to
grant or deny the request for variance.

This letter is in response to the request of Frank Kirwin for a use
variance to locate a landscaping business on Lot 1 of the Hoag Subdivision
adjacent to Ute Avenue generally across from the Gant Condominiums.
The property is zoned R-15 P.U.D. and a landscaping business is not an
allowed use in a residential zone. The property is located in a
documented snows1ide area. A single-family house would be allowed by
right on this subdivided lot as it is exempt from P.U.D. requests and
not subject to avalanche review.
The Planning Office feels that this proposal represents a unique solution
to a development problem. Certainly the original platting of this Lot
1 of Hoag Subdivision was a mistake. Given the ability to build a
single-family home on this site, a use such as a landscaping business,
which will occur only in the summer months appears to be a reasonable
use of this lot. We would recommend the granting of a variance to Mr.
Kirwin for the use of Lot 1 as a landscaping business due to the parti-
cular unique circumstances involved in this lot.
We would recommend that Mr. Kirwin be required to revegetate with
indigenous materials the earth berms and mine tailings which surround
his site so as to better harmonize this business use with the resi-
dential neighborhood.
