(Office space requires three per 1000 sq. ft.) The new zoning ordinances have created a hardship to the owner by making the property non-conforming in the amount of parking that is possible to be provided on the site and from the stand- point of access to that parking. (See drawing "Existing Available Space".) The owner has been granted approval by the City Council (February 14, 1977) for encroachment for parking along part of Third Street. (See drawing "Alternate #3 - Proposed Parking".) This Council action allows five parking spaces which would bring the parking into conformance with the existing residential use. This property is presently zoned "0" which intended use is: "To provide for the establishment of offices and associated commercial uses in such a way as to preserve the visual scale and character of formerly residential areas that now are adjacent to commercial and business areas along Main Street and other high volume thoroughfares" (from City of Aspen Zoning Ordinances dated January 1, 1977). . Now that it is possible to have the five parking space~ the owner would like a variance from the required parking for office use. The existing structure contains one studio apartment of 512 sq. ft. which will be retained and a four bedroom apartment of 1737 sq. ft. which the owner wishes to remodel to office space. Th.e owner al,so would 1 ike to add approximately ,750 sq. ft. of office space primarily in existing attic space and adding a . second floor over the studio apartment. This addition would not significantly change the "footprint" of the structure. With the proposed office use with the studio apartment, the parking requirement for the office (2487 sq. ft.) would be seven spaces plus one space for the apartment for a total of eight. Specifically, the owner is asking for the required eight parking spaces for office plus apartment use be reduced to five or less. It should be noted that the property fronts on Main Street which is a primary mass transit artery. We feel that the parking provided as shown in City Council approved "Alternate #3" would be sufficient for the office plus apartment use proposed. This parking arrangement with planting screens would give relief to the owner and allow for the improvement to the property..."with- out substantial detriment to the public good and without substan~ tially altering or impairing the intent and purpose of the zoning district regulations. .." This memo is in support of the application for a variance to reduce the off-street parking requirement for the Morse residence located on Lots K, and L, Block 44 of the City of Aspen (North Third and Main Street). We have discussed this matter with Russ Pielstick and through a quirk in present zoning he is unable to come forward to the Planning and Zoning Commission for a review of the parking on the site through the special review mechanism. As you may know,' the current zoning on Main Street was designed to encourage and create incentives for the preser- vation of historic structures through economic incentives. Also, due to the physical configuration of Main Street with respect to small lots, large homes and narrow alleys, we created flexibility in the off-street parking requirement in order to accommodate higher economic uses of property that would have the effect of preserving historic and perhaps even marginally historic structures. The conversion of the Morse residence. to office space is such an economic use and is one that should be given serious consideration for a parking reduction. In the application in question, it appears that parking beyond the five spaces provided would create an adverse visual impact on the site and detract from the quality victorian setting.
