TO ALL PROPERTY OWNERS AFVECTED BY THE REQUESTED ZONING OR USE VARIANCE
DESCRIBED BELOW:
Pursuant to the Official Code of Aspen of June 25, 1962, as amended, a
public hearing will be held in the Council-Room, City Hall, Aspen, Colo-
rado, (or at such other place as the meeting may be then adjourned) to
consider an application filed with the said Board of Adjustment requesting
authority for variance from the provisions of the Zoning Ordinance, Chapter
24, Official.Code of Aspen. All persons affected by the proposed variance
are invited to appear and state their views, protests or objections. If
you cannot appear personally at such meeting, then you are urged to state.~

as the Board of Adjustment will give serious consideration to the opinions

Subject: Application for a Variance Number 77-32; The Koch
Luaber Property.
Gentlemen:
Even though the Koch Lumber site has had a commercial use tor
a long time, I think it is in the best interest of the community
not to extend or perpetuate the commercial aspects of the property.
The subject area of town is basically residential consisting of multi-
family units. I have under construction a nine unit condominium
project on the southeast corner of Cooper and Garmisch, across
from the applicant's pr0perty.. I do not object to the continued
use of the property in its present condition. However, I oppose
the granting of a permanent variance to allow a commercial use of
the property .'v for' an indetermina te period of time.
Incidently, I would support a.n application for Ie-zoning from
R-6, residential to R / MF, Residential Multi-family, which I
believe will be the best use of the property.
It appears to me that the granting of this variance application
would be a de facto rezoning from residential to Commercial.
Therefore, Irecommend to the Board of Adjustment that they do
not approve Application Number 77-32.

Gent lemen's
As representative of the Aspen Townhouse Central
Condominium Association located at 124 E. Durant St.,
Aspen, Colorado, I have received notice of the Use
Variance described in Case 77-32.
As close neighbors to the property involved, we
have no objections to the requested variance if it
includes only the roof repair and installation of a
gas heater. We would object strongly if, as an
extension of these variances, the property becomes
an obvious commercial establishment with signs,
litter, abandoned equipment etc.
Although the property appears run down. we consider
it to be one of the few remaining scenes of historic
old Aspen. and would object strenuously if this was
basically changed.To all outward appearances it should
be preserved as it stands.
Your consideration of these remarks will be
greatly appreciated.

comments re the variance request b1 Aspen Painting t
If the building in question is to be used for paint storage, it
ShO\lld be modified to ceaent block or brick construction, or at
least eomplete~ ~ walled with S/8 1 hour tire rated plaster
board. It not, then I would objeot to its being used in this
way n8sr residential property.
The Aspen Fire Department should guarantee the building safe in
regard to tee above.
It this Viriance i8 granted, no precedent should be establiShed
for turtherl8Oditications or variances granted to other buildings
surrounding or near or within the City.

Gentlemen:
I strongly oppose the proposed variance from
the existing zoning for the building facing West Cooper
and running parallel to Garmisch Street. Use of this
building for a shop and storage of equipment would add
industrial traffic, delivery trucks, pickup trucks, and
other noisy and destructive vehicular traffic to the area.
This area is a residential area and is one of the most
quiet and desirable locations. Changing its character
by the introduction of heavy truck traffic would do dam-
age to the road. It would be unsightly to have paint
trucks in the area; it is a potential fire hazard to
have paint stored in a residential area and generally
would destroy property values in the surrounding area.
I urge you to reject the requested zoning
variance.

RE: Koch Lumber Building
I am informed by the City Attorney that there is a proposal
to allow paint storage in the old Koch Lumber Building on Cooper
Street. .
I feel this is a very bad idea. We have had a couple of fires
in that building just recently. The building as its exists now is.
still a great fire hazard. 11y attempts to have the present users
of the building reduce the fire danger have met with resistance and
disinterest. In addition, certain portions of the building, because
of the last fire, are in danger of structural collapse.
To make this building safe for paint storage would, in my
opinion, essentially require that the present structure be torn
down and rebuilt from the ground up.
